Hi guys,

I'm just wondering at what stage can I apply for work permit within canada after applying for PR under CEC. In the cic website it says that work permit application inside canada is possible after passing certain stage in the PR application. Does anyone have this experience?

Thanks!

You can apply for or extend your work permit whenever you applied for PR under CEC. I extended mine this August and got it at the end of September. I applied for PR April.

Did you apply in open work permit category?

Can you provide the link for the specific CIC webpage that says this?

In the past, this has been true ONLY for family-class applicants (not economic-class, like CEC).

Thanks apple2012.

For jes_on and ujbaby - the link is right here www(dot)cic(dot)gc(dot)ca/english/work/apply-who-eligible.asp

Eligibility to apply from inside Canada

You can only apply for a work permit from inside Canada if:

you have a valid study or work permit, or your spouse or parents have a study or work permit
you have a work permit for one job but want to apply for a work permit for a different job
you have a temporary resident permit that is valid for six months or more or
you are in Canada because you have already applied for permanent residence from inside Canada. You will have to pass certain stages in the main application process before you can be eligible for a work permit.

I've a job offer from my previous employer and they'll be submitting the LMO in to SC soon.

CEC applications are still classified as "outland" applications, not inland, even if you are currently residing in Canada. The above applies to inland (e.g. Family Class) applicants (I realize it doesn't say that)..

In any case, do you currently have a valid work permit? If so, you can apply for a new work permit in Canada, with the LMO, regardless of your PR application. If not - what kind of permit do you currently have?

Can we really extend our out Work Permit based on PR application crossing certain stage. I am not sure about this as I though you always need approved LMO even to exten your WP.

Seniors Please advise!!

u can't apply for Work permit during cec process unless u get a positive LMO.. There is no certain stage to pass inorder to obtain work permit under this category other than obtaining a positive LMO.

This does not apply to CEC. This only applies to spousal sponsorship applications filed through the inland route.

No - you definitely cannot if you have applied through CEC.

You need a new LMO.

@jes_on:

CEC application has to be mailed to Sydney, Nova Scotia (only), so is this an "outland" application? I don't understand what you mean by inland vs outland. I thought since we have to send the application to Nova Scotia that means it's an inland application. Please advise :D

Also, I've asked David Cohen about it, apparently I can apply for work permit inside canada as long as I've LMO during my PR application.

I had a work permit which already expired in June, went back home so now I'm on my visitor visa.

Outland means it is processed outside of Canada. The CEC is a bit different because even though it can be processed "Inland", it is considered Outland for other purposes.

The point of the other posts is that extending your work permit has nothing to do with the CEC. If you have a positive LMO, you can apply for it. You qualify based on the LMO, not your pending CEC application. The CEC application doesn't prevent you from extending the WP if you meet the criteria. The specific line about have an in-process PR as an eligibility criteria relates to family class applications only.

that's sad I was hopping we could get an Open work permit, before getting the PR. Anyways this is a fast program, so it shouldn't take a lot of time.
