Experts, please throw some light on my situation.

I applied for my PR to New Delhi Visa Office with a transfer date of September 2010. No communications so far. My status keeps saying "In Process" and inside, it says, "Received by NDVO" for the past 8 months may be. In the meantime, my employer transferred me from US to Canadian head quarters on a work permit initially for a year. So, I entered Ontario back in November 2010. My first year expired two months ago and my Canadian employer applied for LMO and extended my work permit for another 2 years (along with this, my wife got her open work permit as well). So, we both have our work permits until end of 2013. I am wondering if I will be able to leverage my work permit status and my one year experience and in any ways speed up my current PR application? Just curious. I am thinking the recent LMO that got approved 5 months ago is applied only for two years? My employer is a multi-national giant and for all practical purposes, my job is permanent. Its only two years from work permit stand point. With my above situation, is it possible to obtain AEO from my employer and speed up my application process in any ways? Any recommendations or suggestions are highly appreciated. By the way, for AEO, do I hae have to be in one of the 29 NOC classifications? Also, does anyone know what's the current processing time for AEO applications?

1. It might not speed-upanything drastically, but yes, it'd be looked@positively... thus could get some faster reviews.
2. Have u updated all that with ur IO? If not do so asap.
3. Yes, an AEO addnly could help. And yes, in that case - u r out-of the 29 loop.
4. The processing time for FSW2 [AEO cases] remain same, a tad slower though, 'coz they need to assess the employer as well.
5. But, a TWP+AEO gets treated well... sometimes making the process a bit sooner [nothing dramatical though, as stated b4].

Dear Qorax,
Had a query on your reply # 4
You mean the processing time to get the AEO approved is slower as they need to assess the employer
OR
The process can be slower after getting the PER as well.
My understanding was that the employer is assesed by HRSDC before issuing a positive AEO, the VO does not repeat this process.

I'm talking about ur PR processing under FSW2.
The IO will yet investigate... there r lotz of fake AORs going around, don't u think?

I am a bit disheartened by learning this. I am soooo waiting for my MR. Of course like everybody else.

Yes, you are absolutely right......there are many fake arranged employment offers around. I have attended a few seminars and had meetings with various consultants in Dubai and very well know this fact. Though i was tempted myself, but better sense prevailed and god sent me a very kind person with an opportunity to work in his company.

Since the AEO is issued by HRSDC, I didn't think the VO would also double check if HRSDC have done their job properly. I understood that it is the role of HRSDC to determine if the job offer is genuine before approving it. What I thought to be an advantage in processing, has actually turned out to be slowing down my process.

Qorax, thanks for the quick, prompt and detailed response.

With reference to point 2. When you said IO, did you mean Intake Office or Interview Officer? Either case, I updated the Visa Office with my last one year and haven't updated my recently extended 2 years. Just so you know, my current application with the Visa Office is under FSW-1. Without sending a new application, would I be able to convert my current application to FSW-2? From my researches, I learn there are two types of AEO. The first one is where the HRSDC issues an AEO to the employer where the prospective applicant cannot work until he / she gets the PR. The second one is where, the employer can apply for LMO and once the employee gets Work Permit, the employer can issue the employee an unconditional Employment Offer which, the employee can submit along with the FSW application. I found this from the below link. I am assuming the second type of AEO also falls under FSW-2. Also, hoping this second type of AEO also doesn't fall under the 29 Classifications.

Along the note, would it be a good idea for me to cancel my current application and apply fresh under FSW-2 (second type AEO). That way, my application may be processed faster. Just so you know, my NOC was removed from the list post June 2010. But, if I apply under AEO (FSW-2), then I won't need my NOC to be in 29 list. Awaiting suggestions.
