Hello all~

I've lived in China for almost 9 years and here are the details.

1)Own no Chattels in Canada or residence
2)Return once every 2 or 3 years for 2 - 3 weeks for visiting
3)Have Bank Acct, and 2 Credit Cards for use for time in Canada, and CCs are a convienience worldwide
4)No affiliations in Canada besides relatives, no RRSPs, all cashed out
5)Have Ontario Health Card, Drivers Licence (Because Chinese licence cannot be certified worldwide)
6)Wife has PR card but only because it was cheaper than a visitor visa and since we are married, never expires. She also has a SIN so do I
7)Wife owns Chattles in China, 2 apartments

BASED ON THESE FACTS would we be considered a tax-resident? Should we receive a clarification by the CRA?
Also if we ever decide to move back we do not want to have a battle with CRA so this is important to us. Right now we are not considering it.

Based on the information you provided, you would likely be deemed a non-resident. For absolute assurance, you can ask for a CRA determination.
