Hi everyone, this story starts on 2002 when my husband was deported from Vancouver BC with his family after their refugee application was denied, last month we applied for a work permit which was denied because an ARC was needed for him. As far as I know to get this type of authorization is almost impossible but I just want to understand the logic of the procedure, I mean why my husband´s brother was able to get a work permit and a permanent residency in Canada considering he left the country under the same conditions as my husband? The only difference is that my brother in law paid for his return ticket ; perhaps the type of job helped too. We are considering to get legal help but it would be really helpful to read opinions. Thanks in advance!
 
Has your husband paid back the cost of his flight out of Canada? That part is essential for an ARC.

An ARC is certainly not impossible - we see lots of people approved here - but it takes additional time and fees. Your husband will need to pay a $400 fee along with repaying the cost of the flight that was used to deport him to get the ARC approved.

His brother would have gone through the ARC process as well - but would have paid quite a bit less in fees since he paid for his own removal.

We didn´t pay for it since we weren´t truly aware of the process, I really appreciate that you took the time to answer I´m trying to learn about it and your opinion has been enriching.

You can't apply for the work permit without having applied for the ARC and repaying the fee for the flight out of Canada.
 
Would actually recommend applying for spousal sponsorship over work permit after you have finished with ARC. Assume you are Canadian.

Our only option is to apply for a work permit with an LMIA since we are not Canadian, do you think this might reduce our possibilities to get a positive answer?
