Hello all!

It's Isik from Turkey. I am studying Business Administration in Istanbul. To give brief information, I have lived in Canada for several years since I had my PR in 1998, and haven't been to Canada since 2006 due to family reasons. I am 23 years old right now and my father and both of my younger siblings are Canadian. As searching for my rights as a PR, I started working with a lawyer and we will submit the PRTD application on H&C grounds next week.

If all goes as planned and I get my PRTD, I want to continue my university degree in Canada, hopefully York University. Though, the application deadline for most universities is in April for transfer students, I had concerns on how to apply. I do not think that the answer for my application for PRTD will come out that fast to meet the deadline.

So should I state that I am a PR, or apply as an international student? If I apply as a PR, would that come to the notice of the Immigration Office before my application to PRTD is processed?

There’s no way to predict the timing on a H&C case, so suppose you do apply by the transfer deadline as an international student—how do you expect to apply for a study visa/TRV? You can’t do so until your PR status is renounced.

Others may comment, but I think you can’t proceed at all with enrolling until the decision on your case is reached.

At 23 years old, the chances of the PRTD being refused are unfortunately quite high (we are even seeing some 19 year olds being refused these days). Make sure you have a back up plan in place in the event the PRTD is refused and your PR status is lost (e.g. coming to Canada on a study permit instead). Agreed the April enrollment probably isn't possible since the university will want to see a valid PR card. However you can try.

Thank you so much for your answers. Thinking and doing some research about it, it does not seem quite possible to apply in April or get my PRTD since I have lost most of the documents needed, in the past years. I'm thinking about crossing the border from US to Canada. As much as I am aware of the CBSA does not have the authorization to terminate my PR status, so that they would have to let me pass the border. I believe they can report me, most likely they would. In that case how does things work? Am I able to apply for a PRC and work while waiting for the new enrollment period for universities?
