Hello,

My common-law partner and I have lived together for almost two years (one year in Canada and one year in Australia). He will be moving back to Canada in April 2014 (under a working holiday visa) and at that time, we will be apply for me to sponsor him for PR (3900). Although we will be moving to Canada soon, we plan on applying outbound (even though we will be living in Canda) as he will be able to get medical and police checks down here beforehand while we are in Australia and from my understanding, the processing time is much shorter in AU vs CND. I have been filling out the application forms (so that we will be ready to go) and on visa form 5409 it asks for a Commissioner of Oaths name and signature. My question is, although we are applying outbound, can the Commissioner of Oath be from Canada since that is where we will be living as of April?

I really appreciate any help I can get.

Note that IMM5409 is only required if the sponsor has a co-signer (read the checklist), which is not applicable to basic spousal family class cases. So that stat declaration of common-law is not even required in your case
