Hey all,

I just have to say that I love this website. The information on here is great.

I just have a few questions.

My husband is from Greece and we recently got married here in Ontario. He moved here so we can be together. We are just putting the paperwork together now to send off so he can become a permanent resident.

My question is:

Can we apply outside of Canada while he is living in Canada with me right now? I heard that if he is in Canada he has to apply inland? Is that true? The reason is because we want to go to Greece in the summer for a big family event.

Also, if we apply in Canada and we go to Greece for 3 weeks, can we just show our Marriage certificate when we come back to Canada and tell them that we have sent in paperwork so he can get his permanent residency?
 
If you have strong family ties outside of Canada I suggest you do a OUTLAND application from in Canada , you can still come and go to Canada and Greece as often as you like with this option, If you do INLAND , you are in for a long wait for PR and then you run the risk of coming back into Canada and being refused entry even though you applied inland or you PR application can be classed as abandend. Many of us here applied inland and deeply regret it as we feel our applications have taken so long, some cases can take between 8 months to 3 years . Lots of us here have family members who we miss so bad , and not seeing them for a while can become frustrating , so , there ARE people who have applied INLAND and have run the risk in leaving Canada for a holiday to return to see their loved ones and have had no problems getting back in, but theres always that 50/50 chance you will be refused entry.

The only "easy" thing about inland is you are together with your spouse. Thats the ONLY good thing about applying Inland. Im an Inland applicant and ill be straight up with you..

Right now first stage approval takes about 9 mon ths and second stage approval which leads to PR takes another 9 months.

Depending on which country your spouse is from and if he requires a visa, if you leave canada while your application is still in process, and he cant get back in for whatever reason, the whole application is cancelled and you have to start all over again regardless of what stage it is in!. this is especially true if you require a visa to come to canada.

If your PR application is denied you have no right of appeal and all your 18 months or whatever time it took to wait goes down the drain and the person thats sponsored has to forcefully leave the country!. There are absolutely NO exceptions and YES CIC gives you a certain date to leave and/or even book your ticket for you at your own expense.

You cant work,drive, have gvt health insurance before the first stage of approval but after the first stage you can actuially apply for an open work permit. but its not a guarantee that you will get the first stage esp if your application has problems with it . ie if the sponsored is in the country illegally, or has previously sponsiored someone else before, or if its suspeted as an illegal marriage or God knows whatever the IO sees and raises red flags.. you never know!.
Andf if this happens, your file is transferred to a local office which i understand can take six months upwards for you to go for an intrview then they determine if you are worth it.

The Inland route is actually the most unfair of this procedure in my opinion.
Depending on your situation and what you deem fit, you may wanna go the outland way, at least you have the right of appeal and your spouse can still live with you in canada for six months at a time and depending on what country he is from, it may even be faster and less stressful than the inland route.
I advise anyone doing the Inland route not to plan for any vacations, travel outside canada until your process is finalised as this may lead to problems.

Yes, you can apply outland while in Canada... if an interview is required it will be done at the outland processing office (Greece) so your spouse would have to go here to have the interview.

In either case, if the spouse being sponsored leaves the country they run the risk of not be allowed back in when they try. Yes, you can show them the marriage cert and any paperwork but there is no guarantee that they will allow the spouse back in.


My opinion... apply outland and then do not travel unless absolutely necessary.
