Hi Experts,


I immigrated with my wife and 2 kids on 2009 as PR. My wife and kids remains in Canada while I returned home for work. I am planning to surrender my PR card as I am not meeting the residency requirements. My questions are:

1- Can my wife (who is still a PR and currently in Canada) sponsors me while she is currently unemployed and I am the main supporter for the family? I found many contradictory answers to this question on the net. Can you please provide me with a solid answer.

2- Does surrendering a previous PR status will affect the sponsorship application?.

3- In case my wife applied to sponsor me and then later she left Canada (She may leave after applying for the citizenship), does this affect the sponsorship application?.

4- Can I apply for a visit visa to see family while there is a sponsorship application in process?.

I will appreciate your advice.
 
1. Yes - she can apply. There is no income requirement to sponsor a spouse. She just can't be on social assistance / welfare and can't be bankrupt.
2. No - it shouldn't.
3. She can leave for a short trip (2-3 weeks). However she must phsyically live in Canada while your PR application is being processed. One of the conditions for sponsoring a spouse if you are a PR is that you must be living in Canada. If she leaves Canada for a prolonged period of time and CIC finds out, the application will be refused for lack of residency.
4. Yes - you can.
 
So you became PR in 2009. Is the expiry date on your PR card not some date in the future, like 2014?? Can you not return to Canada before it expires, stay for two years, AND ONLY THEN apply to renew it? Your residency obligation is not measured until you apply to renew it, and you're not require to renew it before it expires (so long as you are in Canada of course).
