Hi All,

My friend is going to apply for PR under FSW with AOR. His spouse is already a Permanent Resident of Canada. Does he has to include her spouse as dependent in his immigration application? Does his spouse has to go through background/security checks and medical checks etc?

Does he also have to submit Birth certificate and all other documents for his spouse, or only submitting copy of PR card of spouse would be enough?

Any help in this would be appreciated.

Its looks simple but its a kind of tricky....

1. Spouse get PR (At that time why didn't she mention his husband as spouse)
2. Going to apply ( if recently married (how) then ask her to sponsor him as spouse)
3. what the status of spouse when she filled PR and while getting PR if she is married then i think medical will be clubbed together then i think he is already have papers and only require to do landings only,
 
At the time of marriage, spouse was already PR. Which means she was single when she did her landing.

My question is that does she need to be included in the application for PR by husband ?

If the wife has the PR, he does not need to include her as the dependent.
However, he needs to mention her as his wife in the generic form (00008 I guess) and the Family Information form.
He needs to include the marriage certificate as well as copy of her PR card.
Also, I would suggest him to include an explanatory letter about the situation.

I was in the same situation when I applied and did as above. Except I did not include the latter when I applied first and they returned my application.
Obviously, the officer did not pay attention to my wife's PR status and asked me to include her as dependent. the second time, I included the letter as sent back all the forms as before; thus, everything went fine.
