Applying as skilled workers while waiting for a hearing?????

Hello!!
We decided to apply for a travel document to return to Canada as permanent residents. We dont want to take the risk of just going to Canada and hoping not to get reported for not meeting the residency requirements.

We will probably not get a TD, but want to appeal the decision under humanitarian grounds.

My questions is can we apply under the federal skilled worker program next year while waiting for the hearing? Is it possible to do both?

Generally I don't think that it is possible to apply for any immigration or visit visa if you are currently a permanent resident, even if you are in the middle of an appeal.
