apply outside or inside canada for Common law partner sponsorship???????

Hi,
I am from Germany. Me and my boyfriend live together now over a year. He wants to sponsor me!
What is the best: APPLY from outside Canada or inside Canada?
Can I visit him if I would apply from outside?
How long does it take?
What is important that he can sponsor me? Does he need money?
And If I am than the common law partner ..is there anything what could be negative for me? (like he has Depts ... do I have to pay it off, if something would happen with him? sorry)

As far as I know if you choose Inland traveling is a "no-no", and there is NO appeal.
From what I know(my case) it is hard to get a TRV, but if you are visa exempt then your ok for visits.
You can apply as outland while inside Canada.
There are no income requirements for the sponsor(but a detailed explination of how he will support you should be included).
The processing times vary from country to country/inland/outland.
As for the debt I am not sure so will leave it to someone that knows to answer.

There are a LOT of helpful people here with a wide variety of experiences, you will get loads of help! Just hang out a bit, it's a weekend and a holiday at that.

Outland is definitely better. At the moment, inland is a total of 14 months. Outland through Vienna (processes German applications) is a max of 11 months; that is how long it takes to process 80% of apps, so quite a lot take even less time than that.

You are visa-exempt, so you can spend the entire time in Canada with him if you want. You can enter for 6 months as a tourist, then extend that if you're PR is still not done.

There is no income requirement for him to sponsor you but he cannot be receiving social assistance and will need to show that he can support you without going on social assistance.

I believe that you can only be made responsible for his debts if you guys combine assets. Example, you buy a car in both names, he defaults on his debts and they can take the car.

You are visa exempt, you can enter Canada with less hassle. So, come to Canada, then send in your application. Choose Outland even though you would currently be inside Canada. You can then stay with your partner while waiting for the process.


There are others that know more about the process, hang in and wait for other replies.

Exactly that . You can be inside Canada but still apply outland. In fact, I think CIC suggests that people do this simply because of the processing times.

Outland is very flexible. You can send the app while in or out of Canada, you can be in or out during the processing, you can send it while in Germany and then go to Canada to wait it out, etc. Inland has ZERO flexibility, you have to be in Canada and stay in Canada the ENTIRE TIME.

I sponsored my partner while we were living in the UK, then we moved to Canada halfway through the application.

Yes. If you apply in Canada, then go back to Germany for a few months, then return to Canada, there isn't much of an issue for you because you are visa-exempt.

If you get yourself a work permit in the meantime, then you can of course work. However, this is something completely separate from the PR app if you are applying outland. You would have to apply and qualify for the work permit on the basis of your education, experience etc.

Were the people denied visa-exempt? Entrance isn't guaranteed but I've not heard of a visa-exempt person refused entry at the border when they show a PR app in process, sufficient funds and proof (either a ticket or funds) that they will leave at the end.

If you want to travel back and forth between Germany and Canada, I would go Outland. Inland is really only for people that don't want to travel or won't be able to get back in to Canada easily (i. e., someone needing a visa). I would find the Vienna thread and look at their spreadsheet. It will help you understand how quickly most applications are processed. 11 months is fairly fast for any VO.

As you said, she made a big error. A requirement for entry is proof that the person will leave Canada; by trying to move to Canada, she didn't satisfy that entry requirement and was refused.

Does anyone else know of a visa-exempt person being refused? I'm curious to see how often it actually happens and if there are any explainable reasons as to why (such as above) or if it is simply the bad luck of a getting a horribly mean border officer.
