I want to apply for residency through common law. I have spanish nationality (im also mexican, always have lived in mexico but thanks to the spanish nationality i could travel to canada without tourist visa and now i could apply through the Paris office which will make the process shorter)

I am currently in canada with my boyfriend, i applied for a visa extension for "exploring more our relationship" and got 6 month granted which will expire on october.

I can prove our 1 year living together from june on. So my question is...
I still would like to stay in canada with him and we wanted the possibility to travel so he can meet my family and back again to canada.

So sounds like best choice would be apply outside canada through the paris office that has 8 month processing time, but then...
would i be able to go out of canada before october when my visa extension expires, travel for a month and then come back? would they let me back in until my residency process is done? meaning another 6 months as a tourist? or is it too risky??

would it be easier to apply for a second extension of stay?

i really want to travel with my boyfriend but only if i have a chance to get back in canada with him.
and i would love to take advantage of the short processing time in france office but only if i can live with him while process is done. im just scared that if i apply outside they dont give me another visa extension or they dont let me back in after our vacations.

What would you guys advise? im not considering the in canada application since times are waaay longer buy i would love to hear suggestions.
Thank you soooo much!!

I haven't had dinner yet, so I may be delirious, but...

If you leave Canada it might void your current visitor visa (unless it's a multiple entry visa?).

Others will confirm either way: delirious, or correct. :)

Good luck!

Only a little bit delirious :). OP is here on a visa-exempt Spanish passport and so can't have a multiple-entry TRV. But OP's visitor status does end when s/he leaves Canada.

Once you leave Canada, your visitor status ends, regardless of whether you've applied for an extension; if the extension app is processing when you leave, it is essentially void. You would be re-assessed anew on your next entry to Canada.

As a Spanish national with a PR app in process and travelling with your Canadian partner, there isn't much chance of being refused re-entry to Canada. However, entry is never guaranteed and no one on this forum can tell you definitely that you will be allowed back in.

Thanks for reply!! Sorry i should have explained, my plan is to leave right before my extension expires...so ill be leaving canada and when i come back i will not have the extension valid...i would have to just get a stamp for other 6 months..just wondering if that will be hard since i will be on vacations maximum a month and i will be having the application for residency sent by then.

hope i made myself clear, and thank you soooo much!!

As I said, entry is never guaranteed but you shouldn't have any issues.

Thanks you for your answer!!
What about the visa extension? if i decide to not go on vacations is there a good chance they will extend my visa another 6 months even if my application is outland?

Im just trying to figure out what is my best chance to be with him..go out before extension expires, have vacations with him for a month, then re entry canada.
or staying here and apply for a second extension without leaving.

I know no one can say for sure about the re entry or even if the extension would be granted..but what you think would be my best bet?
thanks again!!

If you leave, your current visitor status ends.

You can leave now, or later, but the re-entry `chances' are the same...which seem to be pretty good, IMHO.

ok awesome, i guess we can plan our vacations then, thank you so much!! really appreciate the time you take to answer.
