Hi!

I just wanted to ask - if applying inland for spousal PR, you are allowed to apply for an open work permit at the same time. What form is this? I mean, what application is this OWP on the CIC website? I'd like to know so I know if I need to get another police certificate from Ireland so I have one to send with both apps.

Thanks!

If you are from Ireland, have you considered applying outland through London? You can still apply outland even while staying in Canada, outland vs inland only means the visa office processing the application, not your physical location.

Something to think about. The processing through London VO is much faster than inland, plus you are free to leave Canada for trips home or vacation etc. It is not advisable to leave during inland processing.
By the time the first stage of inland is complete (11-12 months) which is when the OWP is issued, you would more than likely be landed and a PR if you applied outland. See the spreadsheet (link below my post) and look at timelines, most are complete in 4-5 months.

Interviews are rarely required for EU citizens going through London VO. Most visa exempt people apply outland even if staying in Canada, myself included.
Good luck!

Thanks for answering. :)

I have thought of outland, yes - the only reason I kind of want to do inland is so I can keep working in Canada - I'm on an IEC permit right now.

I read elsewhere that if I apply for the Inland PR + OWP, I can keep working under the terms of my IEC permit right up until I get the OWP - implied status.
I just don't want to stop working and have to give up this job I like, as I don't have a ton of savings.

If it wasn't for that implied status, I'd already have decided on outland for sure!

The implied status is true, but it will still be 11-12 months before you get the OWP, outland is completed in 4-5 months.
When will your work permit expire?

Totally up to you of course! You seem to have educated yourself at any rate which is more than some people on here do :)

It expires on June 19th.

I know that it seems to take about a year just for the first phase, and that is a big risk (like, what if I was on implied status and then the first stage was somehow rejected, then I'd be illegally here, right?)

I think I'd be okay with the longer wait if it meant I didn't have to deal with not working for 4-5 months.
I'm just not sure if an IEC permit gives you implied status as a worker if you apply for PR + OWP before it expires, I've seen a lot of conflicting answers regarding working holidays and implied status.

Although if I got an LMO I could do outland and work, right?

Hi, :)

I have exactly the same dilemma. I'm on IEC till September and I've read tons of contradictory information about being able to continue working after it expires.
When I called the immigration twice, they told me that if I apply for OWP before my IEC expires then I can continue working till I get my OWP.
And a few ppl on different forums said the same. Unfortunately, the majority of ppl says otherwise. ???
There is also the problem that according to what I've read on the Canadian embassy in Poland webpage, IEC visa is non-expendable.

Go figure. ::)

have u tried option of getting LMO by ur sponsor and applying wp
