I was accepted to a medical tech school in Toronto for a 2 year program to start 1 Sept 2008. After looking at local programs in the US, I applied there because my fiance of 3 years suggested it as a faster way to enter Canada than marriage + sponsorship. He was unwilling to move to the USA as he is fluent in French and would lose a lucrative job by leaving Canada.
I had read the instructions on the CIC page and understood that I would be required to prove intent to leave Canada. Of course we had already decided we would marry and I would live with him in Canada. So I had doubts about study permit and felt it was not the right way to apply, but he said it would be much quicker than sponsorship. And I do need additional training in my field because I am at a dead end.
So I submitted a study permit application as soon as I was notified of acceptance end of May. 16 June I hear back that I am required to provide some sort of concrete evidence I will return to US after school. Now I am not stupid, and will not lie. Truth is, as soon as I set foot on Canadian soil, I will go to school but also be starting to apply for sponsorship from my husband. But is there any way I can convince the immigration officer to give me a chance to explain before denying the application?
The school, as predicted, is being less than helpful and has basically told me I will not see a penny of my already-paid tuition money back unless I give them a formal letter from the visa office showing why the application was denied. Furthermore this letter has to be in the school's hands BEFORE start of class 1st September. I am very afraid this letter will not arrive in time for me to get my refund. If I simply sit back and do nothing to support my application, I'm guessing it will be closed and visa denied. But this wont START until after the 16th Aug...after which it may take them 2 weeks or more to send a formal letter.
Is there a way I can immediately contact the Canadian embassy and withdraw my application? If I do this, will that result in the kind of letter I need to present to the school to have them release my tuition money? Or is there a distinction between voluntarily closing your own application, and having the immigration officers find it lacking and deny it? Lastly, how will it affect my husband sponsoring me into Canada this fall? We understand you can only have one immigration application open at any time, but we intend to file for sponsorship ASAP and do not want to ruin our chances by having a "suspect" application attempt on my record.
Help...I am a gainfully employed American citizen with honest, moral intentions. I followed some bad advice and now I thing all is lost. And I am running out of time...I just want to resolve this nasty error I've made quickly and not loose US $12,000, it is all I have.
