Hi pals, my application was returned due to undisclosed representative. My agency gave their contact information in my application form but their didn't submit the IMM5476 form(use of a representative). Finally it was deemed incomplete for not submitting the 5476 form and returned to my home addresss. But the agency has done other cases in the same way and have all got passed. Can anybody suggest what could I do? Beside communication with the CIO-Sydney-Search-Enquiry@cic.gc.ca, is there any other approach that I can try for any possible opportunity?
 
If you were using a representative but failed to include the "use of representative" form - then your application was incomplete. Incomplete applications are returned by CIC. I don't think there is anything you can do since CIC followed the correct processes and rules. Your agency is the one that make the mistake - not CIC.

Are you sure your agency has submitted other applications without this form and been successful? Perhaps they are lying to you to cover up their mistake.

Again, I don't think there is anything you can do since your application was correctly returned as incomplete. I would request a full refund from the agency and submit an application under express entry.
 
Yes you are right. And actually CIC is nice enough not to sentence my application as misrepresentation. But the problem is, other case in same condition as mine has passed the review. Then I am thinking whether there would be opportunity to appeal for procedural fairness.
 
I personally don't think you have a leg to stand on under procedural fairness. The rules are extremely clear with regards to the use of a representative form and incomplete applications. But you can certainly try...

I think you have no case here, it will be treated as incomplete. Please try EE
