Hello!
My application was refused today . I can not really understand what is the reason , it explains :




I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your immigration status.

You are welcome to reapply if you feel that you can respond to these concerns and can demonstrate that your situation meets the requirements. All new applications must be accompanied by a new processing fee.

Im Russian, applying in Mexico. Was invited by a friend , had tickets purchased already and the whole trip planned. So my question is
What exactly should I provide to RESPOND TO THESE CONCERNS AND DEMONSTRATE THAT MY SITUATION MEETS THE REQUIREMENTS.

You applied from Mexico. This refusal reason means you have temporary immigration status in Mexico or else you did not provide adequate evidence of your immigration status.

This refusal reason means your family ties to Canada outweigh those to your country of residence (Mexico) due to which you are likely to overstay your visit

I have C-1 US visa valid. Ive been in the US 3 times for the past 2 years. I provided that too

I have nothing in Russia, I don't live there since 2010

In Mexico I have work and Im self employed. Financially set . I provided all the letters explaining in details what I do and how much I make.

Im single.


What kind of papers I can offer to them if I apply again to set their requirements?
Is there chances for my case?

1. Tickets don't help for visa applications.

2. Is your relationship more than just friendship?

3. Did you explain why you want to visit for a short one week visit? Did you submit a visit itinerary with expense estimates?

Your C1 visa only allows you to transit through the US.

Have you been living in Mexico prior to October 2018? If that's not the case then which countries?

This could explain why you were refused for immigration status + your temporary residence status in Mexico does not help too. What was the basis of your temporary residence application for Mexico?

This is another concern that the visa officer has. As a self-employed person, you have the option to work from anywhere in the world. This makes your ties to any one country seem weak unless you have submitted convincing evidence to prove your self-employment is solvent/pays well + you have reasons (clients, projects, etc) to return to Mexico

-I was in Mexico on a tourist status before I got my residency. I applied for it to start a business here
- I work with the hotels and I can request for the contracts for the next 6 month to a year as a proof that I will be working here if that helps
- Yes our relationships is more than friends. We met here while his short vacation and I did not explain anything in my application. My visit planned short because I need to be back in Mexico for my work. I did not submit visit itinerary, invitation letter said I will be staying at his address. thats pretty much it
- C-1 is a transit YES. But it gives me 28 days every time I enter. And it means I went through full check of US immigrations , so I thought that may help. And I entered 3 times, stayed for a couple days each time.

Can we provide a different kind of letter from him? Is there anything he can do to help this as a Canadian citizen?

This was useless because it didn't describe your present situation.

This is what you should have submitted in the first place.

Without any itinerary, you created doubts in the visa officer's mind as to the true intent of your visit.

Still not as strong as a B2, and your travel history isn't as strong as they would like.

He shouldn't have to submit anything...the invitation letter from him is only secondary. The burden of proof lies on you and your ties.

Is there a transit type of visa for 1 entry only that I can apply for ? so at least I make that trip .

Someone will correct me if I'm wrong, but I don't think a Canadian transit visa works the same way as a US transit visa. I believe it's literally just for transit. A single-entry TRV is given at the officer's discretion.

Working for a cruise company possibly added to the inability to demonstrate strong ties to any one particular country = Refusal for immigration status

It would certainly help. You would also want to submit additional proofs such as a business/company website + ongoing projects + work contracts + customer lists, etc.

You submitted proofs of relationship and that was probably the biggest mistake. This indicated you will possibly overstay your visit. That said, you must be honest in your interactions with IRCC.


Unfortunately, it is evident why you were refused. A combination of factors worked against your TRV approval:
1. Temporary residence in Mexico

2. No strong ties to any other country + no immigration status in any other country in the last decade (not even ties to Russia)

3. You're self-employed (you don't have employees, etc)

4. Your business has been recently registered in Mexico + not well-established

5. Your friend is a Canadian = High possibility of you overstaying your visit to apply for PR by marriage/common-law

I provided prove of relationships because they ask for it, and yes its easy to figure out why I want to visit him, I didn't mean to lie , I just didn't think I will have to explain that.

The only thing I see I can provide right now is the contracts from my Hotels .

What would you recommend to do now? Apply again right away with additional proof papers ?

Or it will make it even worse , because they will see that Im changing info If I explain our relationships? Or if I don't say anything about him at all?

What is the best step right now?

I see all my mistakes now. I should have visited this forum before submitting it. I did not register my business. So I don't have papers.
Your temporary residence in Mexico was granted on the premise that you would establish a business. But, you still haven't.

Registering the business, opening a business bank account, a company website, paying taxes, hiring employees or setting-up a supplier network, etc would demonstrate business/employment ties to Mexico = Reason to return to Mexico

At the moment, your employment is your only reason to return to Mexico (assuming it pays well).


The only thing I see I can provide right now is the contracts from my Hotels .
That won't help if the business is not registered.

Do the contracts with the hotels have any financial clause or penalty? Who will manage the work when you are away? Are you required to be physically present in Mexico for these contracts? You can focus on these points when you reapply.

Also, see the suggestions above.

No, IMO it's not a good idea to reapply without the new evidence.

Your previous application is on record. Stating anything significantly different would only raise more red flags
