Application received before change of definition of dependent child rejected.

Hello.

I applied to sponsor my daughter as family member on July 30, 2014 she was 19 years old going to 20, not married and being enrolled in full time school. I have the signed confirmation that CIC received the package on July 31.

The new definition of dependent child commenced on August 1, 2014.
On August 27, CIC returned the application saying that applications received after August 1 were supposed to use another set of forms.

I contacted my MP office for assistance and after they talked to CIC, CIC suggested that I sent the application again with an explanation that it was returned, but as I met the deadline - I would like them to process the application. So I did and I also provided proof with their signature that the package was received on July 31.

On November 2014 I received an email from CIC requesting:
• You must provide a current and completed Application to Sponsor, Sponsorship Agreement and Undertaking (IMM1344) (updated by CIC on August, 2014)

In other to comply with CIC I sent them the new form - even though my original package included the valid form (before August 2014)

I received a letter from CIC Mississauga today advising me I am not an eligible sponsor my daughter as she does not meet the new definition of dependent child.

What else can I do? I cannot appeal until the visa officer abroad has rendered a final decision.

I hate to say it because of the possible money involved, but at this point I would engage a very good immigration lawyer to help you. I think you need someone in Canada representing you to fight this.

I would go back to your MP again also. They tried to help you once, perhaps they can do so again. CIC may be more responsive when an MP talks to them.

Failing that, then lawyer up.

I would legally apeal if I could, but as their letter says, I am not entitled until the visa officer abroad has rendered a final decision about her PR.

I did go to the MP again and they are writting the Minister office as the situation seems to have gone out of hand with CIC.

Im planing to also write a letter to the Minister to cover all angle, if anyone has a template and detail they could provide I would really appreciate it.

The visa officer refused the application as they keep on saying the application was received after August 1, 2014. I already hired a lawyer, is there anyone in the forum on the same case?
