Since I started working in this Dépanneur, I have already requested my employer to pay me by cheque, and also asked for payslips when I got paid for the first time, but he refused. In May 2022, I applied for Canada Worker Benefit, but they refused my application for an unknown reason. I asked for my payslips from my employer on July 27 to make sure my estimate of income was correct on my application for Canada Worker Benefit. However, according to the payslips I received on August 8, 2022, I was paid less than minimum wage since I started working.

My employer paid me $880 in cash biweekly and $11 hourly after taxes, but according to my payslips from February 21 to April 30, my employer had to pay me $889.82 after taxes. In addition, my employer told me that he would not report the overtime working hour, so I was paid only $11 even though I worked more than 40 hours a week. Also, my employer didn't inform me that the minimum wage was increased by May 2022. According to my payslips, he should have paid me $929.67, but I got paid just $880 bi-weekly so far. Also, my holiday pay was 0 on my payslip, despite working on holidays such as Easter and Canada Day. The biggest problem is my LMIA exemption work permit is still in process, so I cannot quit the job right now.

On August 9, 2022. I had a phone call with the employer. I told him my salary was lower than the minimum wage since the beginning. Furthermore, I requested payslips and cheques for future payments to avoid the same problem. He said my salary could not be increased to the current minimum wage. Also, He refused future payslips and cheques. Also, he said that he will report fewer hours to avoid excessive tax payments.

Am I eligible to apply for a work permit or vulnerable workers even if my LMIA exemption work permit is still in process? I applied for it in the April this year. I really want to run away from this dépanneur as soon as possible. Thanks for reading.
