Hello Guys,

We are in a dilemma right now on how to proceed with our application, below are our background:
  • Wife is currently working in Ontario as PSW (NOC 3413) under a closed temporary work permit since September 2021.
  • Getting interviews from AIP designated employers in Nova Scotia as CCA (NOC 3413).
  • Prior to working in Canada on September 2021, she has 10 years of RN (NOC 3012) in Saudi Arabia. This will be her qualifying experience as required and exempted by AIP.
  • Her IELTS and ECA are both valid till January 2022 and November 2025 respectively.

Now my questions are basically focused on C41 exemption for me as her spouse (in case she gets hired by an AIP designated employer and gets her provincial endorsement).

"Spouses or common-law partners of Atlantic Immigration Program (AIP) work permit holders
The principal foreign national must be working in any occupation level in NOC 0, A, B or C, has a work permit issued under any category and approval under one of the Atlantic Immigration Program streams.

The principal foreign national’s work permit must be valid for 6 months after the spousal open work permit application is submitted. The spousal open work permit should have a validity that matches the principal foreign national’s work permit or until the expiry of the spouse or common-law partner’s passport or travel document, whichever is earlier.

The spousal open work permit application may be submitted inside or outside of Canada. It may be submitted with or after the principal foreign national’s work permit application."

Questions:
  1. If her current Ontario employer learns about her AIP application with another employer and fires her from her job, do we still comply with the above mentioned requirements?
  2. If she gets fired and her AIP employer decides to apply for her a temporary work permit (with PR application), can we submit my C41 SOWP together with her TWP?

So far she is getting hired under the AIP program and using the Nomination letter given to apply for work permit/PR, it will not affect her applying for open work permit for you.

Even if she loses her job, so far she is able to apply for her work permit via AIP or temporary work permit, she will still be able to submit an application for you.

Why would she get fired...... dude this isn't a third world country where you can fire someone for applying for another job. It's her legal right to do so, you cannot just "get fired" in Canada unless you have a legal reason to fire someone.
