Hi all,

My family and I are in a bit of a dilemma, my mother is an experienced staff nurse and is interested in applying to work in Canada but me (22 years old and finishing university in the UK) and my brother (18 and finishing sixth form) would like to go with her, would it be possible to be included on her visa or do we have to apply ourselves? Even if we can prove that we are dependent?

If your mother applies for her PR as a skilled worker, then you are considered a dependent child if you are under 22 and single so your brother definitely gets to go on her application as long as he doesn't get married before he lands as a PR. Since you are already 22, you would have to stay enrolled in a full time study program if you want to go with them. As soon as you graduate and get a job, you are no longer a dependent child. If your mother comes to Canada on a work permit, if she goes to ON or AB, your brother might be able to get a work permit based on her permit, see http://www.cic.gc.ca/english/information/faq/work/work-faq09.asp but you would have to get your own.
 
Leon's right. For you to be able to become a PR as part of your mother's application, you'd need to remain a full time student financially dependent on your mother until the day they issue her PR visa, which will take years.

If she'd applied before you turned 22 that wouldn't be the case, as age gets "locked in" the date the application is received. However, student status does not.

Your brother can be included, and will become a PR with her unless he gets married or enters into a common-law relationship.
