Hi all :)

Quick question - can an adopted child who is over the age of 21 (I guess not a child anymore LOL - no blood relation) be sponsored via family class from a non-visa exempt country?

A close friend is asking and I thought who best to ask but the lovely seniors of the thread.

The adopted child can be sponsored up to age 22 only if the child has been studying at university continuously without breaks. For example. Child took a semester off from studying and then back to university. That won't work.
 
When was the child adopted and why? It's possible that it might be seen as an "Adoption of Convenience" if it was recent.

Look under definition of dependent child. The adopted child falls under type B.

It says that the child has been continuously enrolled in and in attendance as full time student since before age 22. Also the child must not have been married as well.

What do you mean by "over the age of 21"? Do you mean like 21 and 7 months... or 22+?

If not yet turned 22, then they can be sponsored as Class A dependent and no need to show schooling.

If over 22, then could only sponsor if they have been in full time school since before turning 22 (Class B), with no breaks or time off from school. And they must continue full time in school right up until visa is issued.

You are correct that if he is 21 years plus a few months. Then he falls under A. However most people assume when they say over 21, they mean 22 or older. When you are 21 years and 10 months old, you say you are 21 years old. Not over 21.
