Hello,

Can anyone please let me know if an applicant is eligible for additional points for PR in case he/she possess W1 worker visa (valid till 2019 Jan) and is currently working for an IT firm in Toronto (ICT) as a senior software developer? Or is it mandatory to complete 1 year of work experience in Canada to get these additional points?

Many thanks

Please answer these questions:

1) Do you have an LMIA?

2) Is your work permit a closed work permit (your employer name is mentioned on your work permit)?

A work permit is NOT a valid job offer. You must complete a year of work experience AND have all the other requirements in order to claim the points for a valid job offer.

Hi Ajith,

1)Not sure on this one, but my visa was processed under "specialized knowledge" and my company also mentioned a LMIA no. On the work permit application form.
2)Yes the work permit is a closed one and its been 2 months for me working on this visa in Toronto.

Thanks in advance...

Hello,

Thanks for your reply, I am already in Toronto and currently working on this work permit (closed, processed under 'special skill" category). It's a inter company transfer for me from India to Canada. My employer had also mentioned a LMIA no when processing my work permit. Do I still need to wait for 1 year before I apply for PR??

Thanks in advance...

You dont have to wait if you indeed have LMIA, if you only have an employer specific work permit then you must work for a year.

Ok you are on LMIA exempt ICT work permit.

To get additional 50 points for job offer you need to satisfy the below 2 conditions:

1) You need to complete 1 year work experience in Canada
2) Get a letter from your employer that you will continue to be employed by them for 1 year after getting PR.

Thanks, is

Thanks, is there a way to check if I have a LMIA? Is this mentioned anywhere on work permit or W1 visa?

You don't have LMIA. You are LMIA exempt.

Hi Ajith,

I have got my ielts result yesterday (L 8.5,R 8.5, S 7.5, W 7.5), I have done my BE and have total of 7 years experience in software development. On the other hand my wife (Mtech + 7 years work ex) could not manage 8 in listening and as informed earlier she has completed only 2 months in Toronto on W1 work permit. Can I apply for PR as a main applicant being in India(CRS score is 440+) for both us? Or wait till my wife gets 8,7,7,7 as she has mtech (CRS 465+).. Please advise.

Many thanks
Jack

Yes you can apply. No issues at all

Thanks Ajith. After reading the whole process, I understand that after receiving the last email we are asked to submit our passport for COPR - how can I manage this as my wife is in Toronto and she will require the PP there and I being in India?

Kindly advise.

You can contact IRCC after PPR and ask to change the passport submission office to India

So we just have to submit the main applicant's passport and not dependents? Because my wife will not be able to courier the passport to India.
