Hello all:

I did try a search but couldn't quite weed through it all to find the answer I was looking for.

We're filling out the Additional Family Information form.

The Guide says to list your spouse/common-law unless he/she is the one sponsoring you. I am sponsoring him, so should he leave it blank?

Then, below, it says that if it is left blank he must certify that he doesn't have a spouse. But he does.. me.

We thought perhaps what it really means is to certify that he has no OTHER spouse... is that right?

How shall we fill this in?

IMM 5406 says to list your spouse or common-law partner in Section A. It says if you don't list a spouse or common-law partner, you sign in Section A to "certify that I do not have a spouse or common-law partner . . . " Now that wouldn't be right if someone is being sponsored by their spouse or common-law partner, right? It does not mean sign to certify that he has no other spouse.

I think what you read in the Guide is for Form IMM0008 - "Your family members are your spouse or common-law partner, if applicable, and your dependent children (start with the oldest). You must include all of your family members (who are not already permanent residents of Canada or Canadian citizens) . . ."
 
Hi, thanks Robsluv. What confused me was on page 5 of the Guide which says,

"Persons who should be included in the application:

If you are being sponsored as a member of the family class, your spouse or common-law partner (except where your spouse or common-law partner is the sponsor) must be included in your application as a family member."

It's not in reference to any specific part of the application pack, but because it says "included in your application as a family member", I was wondering if that meant as part of the IMM 5406 'Additional Family Information' form..
 
my partner (applicant) included my info in the additional family form under spouse/partner, even though I'm the sponsor. Well, he filled the form out, and I noticed that he had included me while I was proofing everything, but it just didn't seem worthwhile to change it after the fact, or print out another form. it was late at night by then and i was mailing the app out the next day.

if it was a mistake, it was a pretty minor one, and I can't see how it would lead to refusal of PR, I mean, it's the same exact information all in the sponsorship part of the application, and it's not an omission or wrong information - those would be much more important.

anyways, my impression is that the "additional family form" goes in your "canadian file" and basically becomes the list of people who the applicant will be eligible to sponsor in the future.
 
I just looked over that form myself and it doesn't say anywhere that you are not to include your spouse if the spouse is the sponsor. The note 1 only says to sign below if no spouse.

The guide doesn't specify anything on this form except to include any children you have even if they are already permanent residents or Canadian citizens. Since they include Canadian children it should not be an issue for the spouse.
 
well, then maybe we got it right, then!! that's good, even if I wasn't particularly worried about it (aside from being vaguely concerned about my reading comprehension and what else I might have missed if I got that wrong).

I think the most important thing, as other have already said is NOT to sign swearing you do not have a spouse if, in fact, you do.

My partner was really torn up about signing to certify that he does not have children, when I'm 4 months pregnant, but I convinced him that they meant "current existing as independent entity" children, not those in utero... :P

No, it would be an issue because, as I already mentioned, if you don't include the name of your spouse or common-law partner in Section A of IMM5406, you are to sign in Section A certifying that you have no spouse or common-law partner. It doesn't say don't include your spouse or common-law partner if they're Canadian - it just says if you list no spouse or common-law partner, then certify that you have none. That would make you ineligible to be sponsored.

Yeah.. my husband went a little signature crazy on that form. Thankfully I caught it before he shipped his forms to me ;)
