I'm sponsoring my spouse from the US. Last year his 13 year old son who lives with his mom and stepdad decided he wanted to be adopted by his step dad. They did the applications and he was granted to be adopted by his stepdad. We got a letter stating my husband is no longer his father by the court. So do we include him in that section or are they talking about something else?? thanks.

No, he is not included. You husband no longer has any parental rights to the child. However, I would put it in the cover letter that this occurred and include a copy of the letter from the court.

What could happen if we didn't include him in there? thanks.

The child is no longer legally your husband's child as a result of being adopted by a new parent so nothing could happen. I would just cover my bases.

Okay thanks!
