Hi there,

Just found out this useful forum and it had really clarified a few things about EE. Thank you!

Per Gazette:
5. (1) In order to be eligible to be issued an invitation, a foreign national must
(a) meet the requirements to be a member of at least one of the classes referred to in paragraphs 2(a) to (c);
(b) meet the requirements of (i) subparagraph 82(2)(c)(ii) of the Regulations, if they are a foreign national referred to in paragraph 82(2)(b); or
(ii) clause 87.2(3)(d)(iv)(B) of the Regulations, if they are a foreign national referred to in subparagraph 87.2(3)(d)(iii); and


Could you please clarify what the two requirements are in b)? where can we find "subparagraph 82(2)(c)(ii) of the Regulations" or "clause 87.2(3)(d)(iv)(B) of the Regulations"?


If i am applying under CEC class, do i still need to have a job offer with LMIA? if my job offer does not have LMIA, would I be in disadvantaged place (without the 600 addiitoinal points)? What can I do to avoid that??

There has been a lot of discussion about this matter, a search on this forum should yield lots of that. The CIC media conference on EE also provided extra info
 
I have the similar question based on FSW too. Now since fsw is not going to have an occupation list. Will i get the extra 600 points?

I have a written job offer , my profession comes under NOC B(3D Animator) and i have about 8 years of experience( 8 months in Canada) including a 1 year post secondary qualification in Canada with an ielts band of 7.5. Can anyone throw some views on this plz.

Hey! Thanks for the quick response! But only my current employer is allowed to apply for LMIA right? If my employer does not want to process LMIA, what else can I do to get a LMIA?

Find another employer who is willing to obtain an LMIA and give you a permanent job offer.

+ve LMIA is given on whether your employer can prove to ESDC that they have made every effort to hire a Canadian before hiring a foreign national. If can't get LMIA or your employer is unwilling to, you can try PNP for the 600 points. (Although many PNP requires LMIA anyway)
Good news is unlike LMIA for temp foreign workers, LMIA for PR is free and will be done in 10 days.

Again, doesn't matter your experiences or anything, you either have LMIA and get the 600 points, or you don't.
