Hi,

I work in the US and applied for PR last year. I have to land before 30-Aug-08 when my visa expires. I was married in Apr'08 and my husband also works in the US.

I understand from posts in this forum that I cannot "land" in 'single' status (as on application). I HAVE to add my husband.

1) Does this mean my current visa becomes invalid when I amend my application to change marital status?
2) Is my application treated as new (i.e., complete re-apply with processing fees etc.)?
3) What are the steps to apply?
4) My husband has a valid canada visitor visa (thought of landing without adding him, what a mistake it would have been!!!)? Does this visitor visa mean anything when submitting his application?

Please help. Thanks so much! (these are great forums!)

1. As soon as you married your PR visa became invalid.
2. You have to return the COPR in your passport, you have to amend you application, complete a new 5406, you spouse must complete a new application. Your spouse will have to submit PCCs Then you will have to wait for medical instructions. Contact the office issuing the visa immediately.
3. His visitor visa means nothing at this stage of the game.

1) If I DO NOT intend to add my spouse to my application process at this time, can I send an application package with all forms (with marital status changed from SINGLE to MARRIED), a copy of marriage certificate, and landing papers to visa office for re-issue of NEW landing papers (only for myself)?

2) Can I apply for adding spouse AFTER receiving my PR card? I can start off PCC process for my husband right away (it may take a while as he needs clearance from 3 countries).

Please advise.

1. Nope, you have to include your spouse's application, police certificates, then he will have to wait for medical instructions, even if you mark him as non accompanying.
2. Only if he is approved, your visa is not longer valid until his application is complete and a new COPR is issued.

Oh! That means I have to now pay my appl fee of $490 again (besides $550 for my husband)!! I just spent $1000 on my previous PR process. The CIC website doesn't talk about any waiver for re-application. Is there none?

No, you won't pay the $490 again, your spouse will have to pay the $550+$490 if you are adding him/her to your application.

Thanks PMM. You have been very helpful!

I have my husband's application ready with U.S. PCC, and intend to submit this application along with my modified appl now. Do these applications have any relevance to my original visa expiry date of Aug 30th? (Should they be submitted before this date?). You said the visa became invalid when I was married.

I re-submitted my application package with updated marital status and all necessary forms/documents for my husband. I also returned my original landing papers.

Yesterday, I received 'Right of Permanent Residence Fee Refund' for $490 from canadian consulate stating that the fee only applies to applicants who are granted permanent resident status in canada, and is refunded when the applicant has not been granted landing.

I understand my husband has to go through the entire process as his application was submitted recently, but my application was processed last year and the only reason I had to return my landing papers is because of the change in marital status.

Please help me understand why my PR Fee was refunded while my application is still in process. My concern is I don't want to lose the current stage of my residency process. I need to know if getting $490 fee refunded is ok at this stage of process, or does it mean I have to re-do the whole thing again?
