Hi all,

Me and my wife and our son got Permanent residency status on May 2013,first we stayed for 20 days then we came back to UAE, my wife and son stayed in UAE all that time,but I resigned from my job and went back to Canada,I was not able to find a job so I kept going back and forth between UAE and Canada, the total time I spent there is almost 1 year in total.

During this time,me and my wife were blessed with 2 baby boys ,my wife still works in UAE and she sponsored them in UAE, now we are thinking to move permanently to Canada,since my wife will complete 3 years out of Canada in May ,and I think that is in line with the residency requirement( Please confirm if this rule still applies or if there is a new changes) .

I have the following inquiries:

1- what is the procedure to sponsor our 2 boys , do I have to be employed in Canada to sponsor them to get a PR.?!,currently I am unemployed.

2- Is there a DNA test required on the 2 boys for paternity test,or the UAE birth certificates are enough.


3- on our PR cards the expiry date on it is : 23- July-2018 and if I subtract 731 days from it which is the minimum residency requirement days to stay in Canada to renew our PR, then from that calculation, 22 July 2016 is the last date where my wife and son can enter without violating the residency requirement, please correct me if calculation is correct or please tell me on which date exactly the 731 days requirement can be fulfilled given the fact that my wife and son PR will expire on 23 July 2018 and they were out of Canada for 3 years now.

4- Do my wife have to resign from her work so I can apply for TRV for my daughters,as a friend of mine informed me some officers required that to know if applicants will go permanenty yo Canada.! please be informed that I have resigned from my work 3 years ago and I am the principal applicant,so can I apply TRV for my girls even though that their UAE visa is on my wife's employer
 
You will have to sponsor the children. Since you and your wife are PRs, one of you will have to be in Canada to sponsor the children. A PR cannot sponsor while living abroad. If your wife stays outside Canada to be with the children, she will not meet the residency requirements. You could apply to sponsor her and the children.

You and your wife could also both come back to Canada in order to fulfill your residency obligation. You can apply for a TRV for the children. This is often refused, since the children are not actually visiting. You then apply for a TRP, which if granted allows them to stay in Canada while the application is being processed.

Is your wife planning on returning to Canada?

1. You don't need to be employed to sponsor them but you do need to show as a family how you will support yourselves in Canada.

2. DNA tests are very rarely requested.

3. The date on your PR card has NOTHING to do with meeting the RO. You need to spend at least 730 days in Canada in the first 5 years after the date you land. If your wife and child don't return in May, they will be in breach of the RO.

4. No, your wife doesn't need to resign.

suppose my wife came to canada after May,i.e,overstaying outside canada than the residency requirement time, how cic would know,i mean will she be caught at the airport, what if we use the kiosk only will it flag her name or something..!!

Going to the kiosk doesn't always mean you skip speaking to an actual CBSA officer. If CBSA has suspicions, they will send her to secondary to ask more questions and look deeper into her file. Whether she gets reported or not is up to the CBSA officer; most of the time, they let the person off with a warning.
