Hi everyone,

My partner and I have been living together since march 2012. He left on May 28 to go back to his country to visit family he hasn't seen in 2 years. Long story short, his plane ticket got messed up and he will be gone for 5 weeks instead of the planned 3. Will this be an issue if we apply for common in law sponsorship when he gets back? I'm not sure how it works if you've already met the one year requirement.

Thanks

if you've met the 1 year requirement, it's fine. You have to be able to prove 12 months of living together. After that, absences are allowed, especially if they are temporary, and it's obvious that the couple is not separated, and the partner is coming back. 5 weeks is not an issue as long as you have already established the 12 months common law requirement.
Good luck,
Sweden
