Hi, I would like to ask if I were doing working holiday in Canada, I stayed more than 183 days, now I am holding visitor record and planning to apply AOS soon,


1) Did you become a resident of Canada (immigrate) for tax purposes in 2019?

According to my situation, I should Answer Yes or No, if yes, there's no option for me to choose my date of entry is 2018. What should I do?


2) Is it against the law if I have a common law partner but we don't file the tax together?

3)my partner should have tax refund last year, he didnt own government any money but he didnt file his tax, is it a problem skip to file the one of 2018 or he must file it??

I am so confusing now, I hope someone can help me and I am very appreciate!

1. Looks like you were on IEC in Canada for 9 months in 2019 and a visitor for the rest of the time so yes you would be a tax resident.
2. You have to declare that you are common law if you have lived together for 1 continous year. Not Declaring it on your taxes is tax fraud.

I am using SIMPLE TAX, when I choose YES for the residency status, they ask what's the date of arrive Canada, however, only 2019 option, Mine is 2018, so means I can't do it online?

1. put in jan1st 2019
2. How does he know he doesn’t owe anything if he hasn’t filed? Yes he must file 2018. It will only help him if he is a tax bracket that owes no taxes.

If you came to Canada in 2018, then the answer to the question is No. You became a resident in 2018.
 
Because we were doing working holiday and we start work at the same time, I got tax refund last year, so he think he doesn't own government money too and he didn't do it
 
even I didnt stay more than 183 days on 2018, I arrived late September and we just start working holiday, so we are resident in 2018 too? :0

That is ridiculous logic. Just because one person didn't owe does not mean another person won't owe either.

Staying 183 days is not the only decider. If you started working as soon as you got here, you were likely required to file in 2018 as well.

Are you sure the isn’t just a software prompt to make sure you are a tax resident. What questions did you answer before being asked when you became a resident?
 
they ask me what's my net income when I weren't resident, I dont know they mean just last year or all the year... they ask me income in Canada and income in overseas
