Hi everyone,

My boyfriend is was here on a study visa which expired in October. He had until January 16th to apply for restoration, which he did under a Visitor visa. He had applied for a Post Graduation Work Permit but was denied based on the institution he went to. He was informed that in order to get residency in Canada, he would need to attend a publicly funded college for at least 2 years. He was misinformed about the details of where he went. Now he has applied and gotten accepted at Seneca. However, seeing as Jan. 16 is nearing, he already sent in all the paperwork for the restoration as a Visitor. Now he has found out that he has been accepted to Seneca.

I am really concerned because I don't want him to leave and I'm afraid he will be denied the Visitor visa and will have to go back. How likely is this to happen? He told me he can only apply for the study permit for Seneca after the visitor visa has been approved.

How likely do you think he is going to be accepted? If they tell him he has to go, how long does he have? Does he have to leave right away?

1. There is absolutely NO surety that his application to restoration of status shall be accepted. Your only option is to provide 'complete details' and to wait for the decision.
2. He can stay in Canada but is NOT allowed to study until restoration of status. If refused for restoration of status, he MUST leave Canada and apply again from his country of residence.

Hi there.. Thank you so much for your quick reply.

I'm just worried. In response to #2.. He was saying that he can't apply for the a student visa while already in Canada (if the restoration is approved as a visitor). But he did say he can stay here so he doesn't have to go back and do the application in buffalo? Apparently that's some sort of loop hole so he doesn't have to go back.
