Hello, i will try to clear everything because i am really worried.
I am from israel, no need of trv visa.
my wife applied for study permit for English language foundationat SAIT college.
May-6 2021apply online from israel
May-8 2021Biometric letter
May-11 2021 Biometric submitted
May-11 2021 (same day) approval.

we arrived to canada and officer asked me to apply for work permit. I did and approved after 4 weeks and received one.
i started to work with Bell, my wife completed her program, and she gave birth to our first baby her in Canada, and she left to visit my home country and I stayed here working. Applied on sept 14 to extend my work permit, but it was refused because there was no lmia job offer. I also applied for my wife for open work permit. (I shouldn’t have to do that). And we both got refused for work permit, my wife came back to canada as a visitor on December. And she applied at Dalhousie university for 3 months english for academic purposes program.
no i applied for my wife as a student, and myself owp. My wife is a dentist, she is 28 years old.I am electronic technologist graduated from the states back on 2012.
She wrote in explanation letter that she is completing her english so she can get accepted for professional dental programs at Dalhousie…
Any ideas if this case will be approved?
Does being from visa exempt country helps in this case?

If she is only coming for a three month program then she only needs a TRV and not a study permit. Also, if she is only studying for 3 months, then I don't think you qualify for an OWP. I believe the program of study needs to be at least six months in length.

I looked online for any limitation for work permit and couldn’t find anything. I am also required to do a restoration of status, so i don’t think there is a limit. Also, her visitor visa expires on jun, and the 3 months program ends on july,

See below. For you to qualify for an OWP, the program your spouse is taking must be eligible for a PGWP. A 3 month language program is not eligible for a PGWP. So you would not qualify for an OWP.

To be eligible, the student must be in a post-graduation work permit-eligible program of study.

Maybe there's a rule I'm not aware of.

I don't think being from a visa exempt country matters that much. I think what matters is whether the progression of studies makes sense. So for me, what doesn't really make sense about your wife's profile is that she completed one english program in Canada and now wants to do a second. Hopefully you provided a really good explanation of this.

Think you got an OWP in error the first time. You shouldn’t have gotten a WP as the spouse of someone attending an English course

My wife’s first program was English language foundation. Now she did the English replacement test at Dalhousie and they ask her to do one 3 months level (the program is 4 levels total) ,, and I mentioned that on the explanation letter.
But what’s really confusing me now is :
How i got owp based on my wife’s English study permit!! Really confusing me

You got very lucky and someone made an error. You should have never received a WP. Not sure how your wife had a child in Canada unless you had private health insurance.

My wife had student’s visa, and she got health coverage from Alberta, we just applied for the free health card, and it covered everything

Is she redoing her dental training or is this a relicensing program? Some relicensing programs do not qualify as study programs so you you would not qualify for an OWP based on the international graduate licensing program. If she is applying for regular dental school it is extremely competitive to get a spot and most programs favour Maritime residents and those with PR or citizenship. She may not get a spot in a dental school or even in a relicensing program so I would look at a plan B. If you are considered high skilled and can find an employer willing to hire you and go through the sponsorship program you would qualify for faster processing time. Depending on your spouse for a WP is risky given getting a spot in dental programs is very difficult.

Didn’t she give birth after she finished her course? She was required to remain in Alberta for a year to qualify for health coverage so to could be billed for all the healthcare she received if Alberta audits your file and didn’t live in Alberta for the first year.

I don’t know if i am understanding your point.
Once she received a student visa, the same week we applied for alberta healthcare, they requested a study permit valid for 1 year,
and a copy of our apartment lease.
thats all needed to get healthcare coverage in alberta.
We left alberta on march, she delivered on june in Halifax, and our valid Alberta healthcare was accepted with no issues.

You were required to make sure you were eligible to receive free healthcare when you applied. Alberta could ask you to repay the healthcare expenses you received incorrectly. Whether the province will when they eventually audit the files is up to them. Your wife and child didn’t meet the requirements to receive a health card or free public healthcare. Would suggest you do your own research since you seems to have run into a lot of incompetence. So far but has somewhat worked out for you but that can change. You are always responsible to make sure you qualify to apply for something or you can be accused with applying for something based on misrepresentation.

International students
If you are a student from outside Canada, you may be eligible for AHCIP coverage.
Students under 18 years of age must be added to the AHCIP account of a custodian.
Students who have a 12-month study permit (valid for an Alberta educational institute) and who will reside in Alberta for 12 months or more are eligible for AHCIP coverage and should apply.
Students with study permits valid for less than 12 months, may be eligible for AHCIP coverage if their application is accompanied by a letter from the school confirming their enrollment and their intent to reside in Alberta for at least 12 months.
Students who transfer to an educational institute outside Alberta or move to another province or territory are no longer eligible for AHCIP coverage and must contact AHCIP to have it cancelled.
