If he is legally separated, then he can exclude his wife from the LICO calculation. He will need to meet the income requirements for 5 people for the last three years in order to qualify to sponsor his parents. Since he is legally separated from his wife, he obviously cannot use any of her income from past years to meet LICO.

Scylla, so his wife can be excluded but his 2 children need to be included. The family size will be 1 himself+ 2 children + 2 parents = 5, right? Another question please: can I be the co-signer for my parents app? Thank you so much!

Yes - that's how you calculate the 5 people. Yes - both children must be included.

No - you cannot co-sign. Only a spouse / common law partner can co-sign. Your brother needs to have enough income on his own to meet LICO.
