Hello,

I am creating this post because my situation is unique. I arrived in Canada in March 2016 and worked until Nov 30 2016 full time (40 hours per week). Due to a personal situation I was forced to spend 5 months in the US.

I am back in Canada now and I applied for my first phase (pre-ITA) this morning. Specifically I answered No to the question "Do you have 1 year of full time canadian experience". Then in my work history I mentioned my latest employment period as March 2016 to present (May 2017) with a gap of 5 months of non-employment (note, not unemployment as my employer was still paying my insurance and I was still in the company's roster).

After I submitted my application, I was awarded 35 extra points and qualified for CEC (Canadian Experience Class). Ideally this should not have happened as I don't have 1 full year experience and I indicated so by choosing "No" to that 1 year experience question.

I had to withdraw my application, as I was worried that they would evaluate my application as fraudulent and that might have permanent repercussions.

My question is: how can I claim less than 1 year experience, show this break from my work and apply as part of FSW. I also read in one of the forums that 1560 hours of work qualifies as 1 full year of employment. Presently I have around 1450, so I need roughly 3 more weeks before I can meet 1560 hours. Is it advised to apply after that or is 1 full calendar year of employment considered for CEC? Please advise.

You can list the two periods of work separately. It will look like two different jobs to the machine, but you can provide a single letter of reference later (with a brief LOE about the leave of absence).

There is a lot of wrong information propogated in forums. Best to stick to the info provided by IRCC. 1560 hours is provided for part-time workers so that they can calculate their one year in full-time equivalence (which by definition takes longer than one year).

The requirement is one full calendar year (52 weeks) of full time experience, where full time is defined as "30 or more hours worked per week." Doesn't matter if it is 30, 40, or 80 hours per week, it is simply "full time."
 
Many thanks. That sounds good. I will split up my experience and include a detailed LOE along with paystub information.
