Hi all,
We are a married couple, 1 of us is a citizen of the country, the other one is illegal and ineligible for adjustment of status (not criminal activity but the initial visa is not eligible for adjustment of status). What chances do we have to immigrate to Canada, the citizen being the principal applicant?

Hello,

As far as I understand, the principal applicant can apply at anytime since he or she is a US citizen. As for secondary applicant, if he or she was admitted to US legally for a period of one year, it shouldn't be a problem as long as there is no criminal offenses against him or her. But I suggest you wait for other folks to reply as well.

Thank you. The illegal one does not have criminal offenses against, but visa expired long time ago and it was valid for 30 days.
