Dear CanadaVisa Forum,
I am currently worried about whether I will be able to maintain my Canadian permanent resident status because I may not meet the 730-day residency obligation.
Here is my situation and timeline:
My family first applied for Canadian permanent residence in 2018, when I was 10 years old. At that time, my parents intended for me to attend middle school and high school in Canada and eventually build my life there.
However, the processing period overlapped with the COVID, and our plans changed significantly. I eventually landed in Canada and became a permanent resident in August 2025, when I was 18. This was 7 years after we applied for immigration.
During the pandemic, my parents gradually gave up their own plan to live permanently in Canada (father revoked PR application process, mother kept PR but don't want to live in Canada). They also became strongly focused on sending me to university in the United States. By the time I received PR status in 2025, I was already in the middle of the university application process.
I want to be completely honest that I did have an offer from a Canadian university as well. However, at age 18 I was still highly financially and personally dependent on my parents. Throughout my childhood, they had made almost all major educational decisions for me, and they strongly preferred that I attend university in the United States. They had also invested heavily in preparing me for US college admissions, including SAT/AP exams and extracurricular activities.
I ultimately received an offer from a highly regarded US university and enrolled there, largely following my Asian parents' wishes and family expectations. Though, I recognize that, legally, I was already an adult and technically had a choice.
During my freshman year in 2026–2027, however, I became much more independent and began seriously thinking about where I wanted to live in the long term. I came to the conclusion that I want to build my adult life in Canada. At the same time, I would strongly prefer to finish the four-year US degree that I have already started rather than abandon it partway through.
My current plan is therefore:
My main concern is what may happen when I return to Canada. For example, I am worried that I could be examined by CBSA and receive a section 44(1) report either:
This issue has been causing me a great deal of anxiety recently (almost to the point of not able to sleep at night), and I would be very grateful for any advice or similar experiences.
Thank you very much everyone.

I came to the conclusion that I want to build my adult life in Canada. At the same time, I would strongly prefer to finish the four-year US degree that I have already started rather than abandon it partway through.
My current plan is therefore:
- Complete my undergraduate degree in the US between 2026 and May 2030.
- Spend as much of my school breaks as reasonably possible in Canada, including pursuing Canadian internships if possible (although still far from the 730 days obligation).
- Return to Canada permanently immediately after graduation in May 2030.
- Seek a full-time Canadian job and establish my long-term career and life in Canada.
My main concern is what may happen when I return to Canada. For example, I am worried that I could be examined by CBSA and receive a section 44(1) report either:
- during a Canadian internship or summer visit before graduation, particularly around 2029; or
- when I return permanently after graduating right before it expires in 2030, possibly with a Canadian full-time job offer already secured.
- In a situation like mine, how significant is the risk of receiving a section 44(1) report at the port of entry? Can I potentially win a H&C if I received 44(1)?
- Would it help that I intend to spend school breaks in Canada, obtain Canadian internships if possible, and return permanently immediately after graduation?
- Would a Canadian full-time job offer, Canadian housing/property ties, and evidence of a genuine plan to establish my long-term life in Canada carry meaningful weight?
- Is there anything I should be doing between now and 2030 to preserve evidence or strengthen my position in case I eventually need to rely on H&C considerations?
This issue has been causing me a great deal of anxiety recently (almost to the point of not able to sleep at night), and I would be very grateful for any advice or similar experiences.
Thank you very much everyone.
