Super Visa 5-Year Stay – Visitor Record Refused, Does It Affect Original Status?

Hi everyone

My mother entered Canada on a Super Visa on September 11, 2023. There was no specific departure date written in her passport, so my understanding is that she was authorized to stay for up to 5 years.

I later applied for a Visitor Record only because we needed the document for another administrative purpose, not because her Super Visa stay was expiring.

The Visitor Record was recently refused under R179(b). The refusal letter does not say that her Super Visa was cancelled, but the officer's notes say she was “advised to leave Canada.”

She also had valid Super Visa medical insurance, but we didn't upload it because the Visitor Record application checklist did not request it.

Has anyone had this exact situation?

Did the refusal cancel the original 5-year authorized stay, or was the person still allowed to remain in Canada under the original Super Visa entry?

Yes, you should still be good to stay for 5 years.

But to be sure you'd better show the full refusal wording.

You need to clarify with IRCC. I would so in writing because the customer service line gives out the wrong information all of the time.

Yes, you should still be good to stay for 5 years.

But to be sure you'd better show the full refusal wording.

Thank you for the reply! I actually have the Officer Decision Notes (GCMS notes) for the refusal. It was refused under R179(b). Here are the exact points the officer made:

1. They noted my mother has been in Canada for almost 3 years and stated: "I am satisfied client has had sufficient time in Canada to complete purpose of stay."
   
   
   
2. They mentioned a lack of ties to the home country.
3. The most concerning part: The officer specifically wrote: "client has failed to provide a valid supervisa medical insurance valid to the requested stay date." (I actually HAVE valid insurance for her, but I didn't upload it because the Visitor Record document checklist didn't ask for it).
4. The final note says: "Consequently, this application for a Visitor Record is refused as per R179(b). Refusal letter sent. Letter sent advising client of decision and advised to leave Canada."
   
   

Given that the officer explicitly recorded a "failure to provide Super Visa medical insurance", do you think this effectively voids her original 5-year authorized stay because it looks like a breach of Super Visa conditions on paper? I'm planning to send a Webform with the insurance proof to clear this up, but I'm really worried about her current status."

You need to clarify with IRCC. I would so in writing because the customer service line gives out the wrong information all of the time.

Thank you so much for the advice! I completely agree with you. I won't bother calling the customer service line since I need a solid paper trail. Instead, I am going to submit a Webform with a Letter of Explanation and attach her valid Super Visa medical insurance. Getting this clarified and corrected in writing on her official file is my top priority right now.

1. Ask for reconsideration as soon as possible and provide insurance.
2. Reapply for a visitor record and for a status restoration.
