Hi,

The pgwp extension of my wife expired last week but she had applied to a Visitor record 1 month ago in order to be able to stay with me in Canada. The processing time is now 316 days, according to ircc site. Can she apply to family class outside Canada (I believe the designation for outland sponsorship), while her VR is processed or only after receiving the answer?

In the case it is possible, there is an online document imm 0008 for sponsorship application, that requires start and end of status dates. We were wondering which date to enter in this form. Can issue date correspond to the day after expiration of her work permit, and the expiration date to 6 months after requesting VR?

Other concern we have is that the answer to the VR application will be received in 10 months, but we applied only for a 6-month VR. Should she leave the country after 6 months?

Yes, she can generally submit an outland spousal sponsorship while the visitor record is still being processed; she doesn’t need to wait for the decision. Since the VR was applied for before her PGWP expired, she can normally stay in Canada under maintained status while waiting.

Wouldn’t count on the 316 days because IRCC is trying to refuse dummy WPs and VRs for people who have expired WPs and SPs faster. Applying Outland is the best option just in case she does have to leave Canada during processing. Assume she has secured private health insurance if she doesn’t live in a province that grants her health insurance through a spouse with status.
