Hello,

Im a canadian citizen currently in Germnay working. Id like to move back to Canada with my wife in a year or two. My wife is an Indian citizen. I just moved to Germany and was in India for 2 years prior to the move(Before that I was in Canada for 5-6 years).
The lawyer is saying Im going to have issues applying for my wifes PR as we are in Germany and IRCC may scrutinize the application. Is this true? If so why would that be?

When you apply, you need to show intent to move to Canada - lease/rental agreement, Canadian bank account with transactions, proof that you have looked for work or have a job on your return etc.
 
If you aren't planning to move anytime soon and have no proof that you are returning to Canada then don't apply.
Yeah looks like that is the way. The issue is the long wait time (12-15 months) so if I decide to move 2 years later its basically 2 years+12 months. But I guess thats part of the wait

Probably longer than 12 but in the next 1.5 years, find a place to live, start showing that you are looking for a job, move money into Canadian bank accounts.

Suggest applying appr. 12 months before you would like to move. First apply with basic info about your plans - but then keep preparing, visit Canada with spouse, look for work - collect docs to update IRCC about plans. IRCC increasingly asks for updates - if you've done work to continue to prepare, should be reasonably smooth sailing. If any further issues come up - you go to Canada immediately and advise "I have moved and am now in Canada." They can't very well say you have no intent to move if you already have.

Get your spouse a visitor's visa now - if residing in Germany, good likelihood they'll issue a long tenor one.

In current situation, even if not complete after 12 months (which hopefully won't be the case), your spouse (with TRV) will be able to go with you to Canada. Won't have ability to work if PR not complete though can apply for one (anyway no need to come up with 20 different 'what ifs'.

One key point: don't plan to move to Quebec. Quebec is capping family spnsorships, huge delays and problems. Perhaps that will change with pending elections in QC, but not certain.

All my life savings are in Canadian accounts so thats not the issue.

Yeah this is what I was thinking. When I was in India I didnt apply for a visitor visa as chances of rejection are too high. Ill apply when we are in Germany
