Hello all,

My company is currently helping me with the OINP process.

They have created an employer portal account and are in the process of creating a job offer.

However, my company’s HR informed me that they cannot select the Foreign Worker stream for me since there is already another candidate from my company waiting in the pool.

The other candidate does not have the same NOC code and is in a different job position. From my understanding, a company should be able to submit more than one application at the same time if the NOC codes and positions are different. Am I correct?

My HR also mentioned that they only see the option to select the International Student stream, which they selected, but I am not eligible for that since my graduation date is more then 2 years

Ple
ase advise.

If your study is more than 2 years old. you are not eligible for the international student stream. and for FSW you have to be with the same employer for at least 2 years. then only you are eligible for FSW.

It's not sorted out. Thanks for your reply.

I am now waiting for an invitation but my work permit is expiring in March 2026. I don't see any draws happening in ontraio (KWC) region.

Now I will have to move back India when my WP expires in March. And my employer can't allow me to work from India. So I will loose my spot in OINP pool. Correct?

Is there a way I can still be eligible in the oinp pool ?

Option is OINP foreign worker stream with job offer. Check scores and NOC selection in past few draws. You don't need to be employed with employer but be willing to support your nomination and PR.

"You don't need to be employed with employer but be willing to support your nomination and PR"

I don't get this. I already have a job offer and and waiting for an invitation. Now what more my company can support?

Your last sentence was is there a way to be eligible for OINP. Your employer has to create a new account/portal with new job id. Did they do that? If they did then ask to see proof that the other potential nominee has a different NOC, account number and job id number. This doesn't let you work longer than your work permit.

If in a high wage job and employer cannot hire any Canadian with the work experience, education and language skills to do the job, they can look into a LMIA. Then once they have documented the recruitment process and no Canadians apply then they pay for and file for a LMIA.

I would say. Just stay positive i am not sure about your noc but tey with pnp as well under express entry. And most important you still have almost 4 months. There will be draw and even pnp quota increased for 2026. Regarding work permit there are ways to apply extension just go with rcic lawyer and they would do it for you. Even you can apply now for extension. So you can remain in canada until you will get final decision for extension and that will add extra time to wait for draw and got invite.

1. Hasn't been an EE OINP draw in some time. Don't know OP's NOC or CRS score.
2. How is OP eligible for an extension without nomination or LMIA or LMIA exemption?
