Dear friends, I have an important question:


When we were refugee claimants, and before we became protected persons, we had a work permit during that time—before the court decision accepted our case. Does that time count toward the residency requirement for Canadian citizenship?


Some people say no, because we were just refugee claimants. Others say yes, because we had a work permit.


Another question:


Before someone becomes a refugee claimant, if they came to Canada on a tourist visa and stayed without a study or work permit—and without making a refugee claim—does that time count toward citizenship?


Does anyone have accurate information about this?

You can count a maximum of one year as a temporary resident (two years of physical presence equals one year of actual time). You cannot count the time while your application is being processed; however, after being accepted as a refugee, that time can be counted

I'm asking because my friend received permanent residence (PR) after being in Canada for 1 year and 2 months. He wants to know whether this time can be counted toward the physical presence requirement.

To clarify:


- He spent 2 months in Canada as a tourist (on a visitor visa).

- He then spent 9 months as a refugee claimant — during 7 of those 9 months, he held a work permit.

- After that, he was a protected person for 1 year and 2 months before receiving PR.



Can any or all of this time be counted toward the required physical presence?

No time as visitor or claimant is counted towards it. Only as protected person and that too is half so one year = 6 months. After PR, full day is counted.

Before pr he only has 7 months for citizenship. Half of the time after accepted as a convention refugee/protected person. After pr every day regular one day.

2 months as a tourist = 1 month
refugee claimant =0
1.2 refugee =6 month
he or she requires 2.3 months as pr to apply for citizen. please note one day as pr = one day

Yes if it is before the claim. Once the claim has been made, they stop counting. If he or she was student or any temporary status, it will be counted as long as it is before the claim
No she was tourist at that time did not have any permit like study or work permit ,

So as tourist without permit it will be accepted?
