Hi everyone,

I have submitted my PR application already and IRCC has requested medical exams for my dependents. When I submitted my application, I listed myself as married even if we were already separated because we had no divorce or annulment yet. I submitted a letter of explanation, affidavit of separation, and a statutory declaration that I will not sponsor my ex in the future plus I submitted proof of a divorce filing here in Canada too. IRCC still asked for medicals of my ex spouse. I dont want to include her in my application.

Would submitting a webform resubmitting all my supporting documents regarding our separation do any help? Or will submitting a webform be an immediate cause of rejection for not being able to provide ex spouse medical?

Even if your ex is not accompanying you, IRCC typically requires medical exams for all dependants listed on the application, including spouses, to ensure they’re not medically inadmissible. This is especially true if you marked yourself as “married” on the forms—even if separated—because IRCC treats that person as a family member unless the relationship is clearly broken down in law or in fact.

Will resubmitting documents via webform help?

- You’ve submitted a statutory declaration stating you won’t sponsor your ex in the future.
- You’ve provided proof of efforts to exclude your ex from the application.

Thank you for your insight. How about for the PCC? Initially I wasnt able to submit any PCC for my non accompanying spouse. I only provided LOE regarding our separation and provided supporting documents such as the affidavit and statutory declaration and proof of divorce filing as the reason why I wasnt able to provide her PCC.

Will IRCC ask this eventually later on? Or would that lead to rejection? Im not sure if IRCC issues a rejection without a PFL first.

So far, I have submitted biometrics and medical is completed in the tracker (me as the principal applicant)

This all depends on whether IRCC allows you to remove your spouse as non-accompanying with proof of separation and divorce. If you provided proof of separation and divorce filing you should not have included as non-accompanying and waited to see if IRCC accepted this.

Sorry. Im not following. What do I have to do now?
 
You should ask to remove your ex from the application and would include proof of separation and divorce filing with the request. Hopefully IRCC will remove them.
Yes I have asked about that too.. Im not sure if IRCC has read all the documents that I have submitted..

Would send a webform specifically asking if you can remove your spouse and would include proof you already submitted again. Dependents likely all got automatic medical requests. If the answer is no then hopefully your ex is cooperative. Other option is to go ahead with the medical request if you are indifferent to including your ex and they won’t have an impact on your PR application.

Thank you. I will try if she will cooperate. At this point I dont have her PCC yet and medicals.
