URGENT- PR spousal sponsorship paperwork returned

My spousal sponsorship paperwork was recently returned to me in the mail due to a missing signature.

I am writing you all to figure out what to do in my situation.

I am an American male here currently on a visitor visa thats set to expire in a few weeks. I applied for it in December and it didnt get approved until just a few weeks ago. I also applied for my PR/ open work permit at that time with the hopes of being on implied status after my visitor visa expired this june until a decision was made for my work permit/ PR

Now I have to re-submit my PR/ work permit papers and I have no idea what to do.

I really don't want to have to leave my wife and e-commerce from home business and really the only life ive known for some years in Canada while I wait for this slow system to process the papers. What is my best course of action at this point in time?

Is there any way to extend my visitor status ? any way to stay beyond its expiration?

Also, how do I go about re-submitting everything? does everything need to be reprinted or what? This is a massive headache over a signature

You should do two things before your visitor extension expires:

1) Submit another visitor extension
2) Resubmit the spousal sponsorship application with the OWP

Both really need to reach IRCC before your current allowed stay ends.

Depending on what type of e-commerce you may be working illegally. Do you have any customers in Canada? Source any of your materials from a Canadian supplier?

You can only have Canadian customers if you hold a work permit.

When you say that you had implied status for a work permit - is this because you previously held an open work permit and then you submitted the OWP application with the spousal sponsorship application? Or are you referring to the fact that you were on visitor status and then submitted an open work permit with your spousal sponsorship application? If the second, then this gave you implied status to remain as a visitor in Canada - but did not give you authorization to work. You have to avoid having any Canadian customers / clients unless you currently hold a valid work permit.

I don't think you hold a valid open work permit. Assuming that's right, you need to change the setting on your ecommerce business not to sell to Canadians / anyone living in Canada.

So just to be super clear, you only have implied status that allows you to work if you were previously on and open work permit and submitted a new work permit application before the first one expired. In your case, you would still need to hold a valid work permit now since your spousal sponsorship application was returned.

You won't be legally entitled to work until the OWP is actually approved. This is why you cannot be selling to anyone in Canada. If you do that, then you are competing with the Canadian labour market - simply put, you are working illegally.

Yes I previously held an open work permit.

To re-submit my application do I have to reprint and refill everything or just correct the missing signatures and resend?

OK - your posts are a bit confusing since your original post mentioned a visitor visa but not an open work permit. Can you clarify the exact dates and visas / applications? These are very important. We would need to know the following. And yes, implied status from a work permit perspective is gone now because your application was returned and since you no longer hold an open work permit.

Dates to confirm:
- when you originally submitted the spousal sponsorship application
- when your open work permit expired
- when you last applied to extend your visitor status (December ? 2021?)
- when your visitor status expires (June ? 20201)

I had an open work permit that expired on Dec 6 2020, 3 year post graduation work permit.
I sent my PR/ OWP package on Dec 3 2020 express shipping and it was received Dec 4 2020 (as per stamp on original envelope that they also mailed back to me and according to tracking also)
I applied for the visitor visa around the same time as m PR/ OWP in case this sort of thing happened, thank god I did.
Visitor visa expires June 4 2020

I plan on submitting the package again via express by this coming monday at the latest.

I am still confused about some things. I am assuming I need to change all the dates and re-sign and print the forms?

Is there a site I can check that mentions if any of the forms have been updated since December so I dont send the wrong ones?

Do I have to get a refund and then pay again?

Not quite clear on exactly what to do and dont want to go through this again.

Thanks for clarifying. So to confirm, you no longer have implied status as it relates to your work permit, however you do have implied status as a visitor which is good news since it means you are not out of status. Apply to extend your visitor status again this week. Try to resubmit the spousal sponsorship application again this week or very early next week if you can. Monday is a good target.

For the forms, generate your form list here and then see what dates are on the most current forms vs. those you submitted.

I don't know about the fees. Hopefully someone else can comment. I believe you can resubmit the forms you already have provided all of them are current and none have been updated.

This happened to me before. You don't have to pay again, make sure to submit the same barcoded receipts in your application.

When you say "all the same paperwork", you should update anything that's changed - including address, jobs, activities, your status, etc.
