Hi Moosas, did you contact ESDC to extend your LMIA expiry or it is automatically extended due to Covid? I did not contact ESDC but I was under impression it is extended automatically. Can you share how you extended this please? I really appreciate your reply.
Hi legalfalcon, can you comment on this please?

Hello @legalfalcon

Yes, I am CEC candidate and the work experience I am claiming is a Canadian experience. It’s not an arrangement employment it was a full time job I did for one of the leading ISP in Canada.

Note: I worked in that company from Jan 2017 to Aug 2019 the letter issued in feb 2019 which demonstrates 2 years of experience until feb 2019

Since aug 2019 until now I am on a visitors visa

Thanks
The day you submit your application it is locked and since you only claimed points for 2 year, subsequent change of employment will have no impact on your score or your application, also since you have explained this in LoE.

Hello @legalfalcon

My spouse has her own EE FSW outland application in process. She recently moved to Canada along with dependant child on visitor status. Our last GCMS notes show file is approved. We received the following letter couple of weeks ago

Dear *******

The processing of your application for permanent residence in Canada is almost complete. You must complete the following steps within 30 days of your, the primary applicant’s Confirmation of Permanent Residence. Please note that this letter pertains to your overseas dependent(s). Passport for overseas dependent(s) should only be submitted once the primary applicant has received the Confirmation of Permanent Residence status. If for any reason you are not able to meet this deadline, please inform us immediately by email to: CPC-CTD-Ottawa@cic.gc.ca with details concerning your situation. As the primary applicant, you will be contacted separately by your local IRCC office in regard to your landing appointment.

The next page of the letter explains how to submit 2 photos and passport copies and return envelop.
We made a little mistake. A week after my wife landed in Canada, she updated her address to Canadian address but she forgot to submit another address change form for our newborn child, who also moved to Canada with her.
We assumed IRCC still thinks our newborn dependent is still out of Canada and issued the above letter. Is it so??
We submitted a new address change form for our dependant son after we received the above letter. We also sent an email to CPC ottawa email id provided in the letter above. We have not received any response form either IRCC or local visa office for our address change forms and email.

What should we be doing now? The letter above mentioned we need to submit passport copies of our dependent (who they assume is still outside Canada) within 30 days of receiving COPR. But we haven't received any COPR yet.
Should we just wait and let 30 days pass?
Any help in this regard will be highly appreciated.

Thank you.
If you have informed CPC Ottawa, they will change the address on file and send you the COPR, just as the primary applicant received. It can takes 5-10 days for CPC Ottawa to respond back. If you do not hear back, send another email and webform.

Also even if the 30 days expire, IRCC will extend it, but in your case extension will not be required.

Your employer, if they intend to retain you will have to apply for a LMIA and once you have that, you can apply for the extension of the work permit.

  • The LMIA expiry date is the date by which the TFW must have applied for a work permit. If the TFW has not applied by that date, the LMIA is no longer valid and employers must apply for a new LMIA, if they still wish to hire a TFW.
  • The LMIA duration date is based on ESDC/Service Canada's assessment of an application for an LMIA. It identifies the recommended length of time that a work permit could be issued to a TFW without negatively impacting the Canadian labour market.
  • The work permit expiry date is determined by IRCC when the TFW applies for a work permit. It indicates how long the TFW will be allowed to work and reside in Canada.

Thank you Legalfalcon for your reply. I had a dual intent LMIA dated Dec 4 2019 to June 4 2020. Based on my LMIA I have a work permit. I heard the LMIAs expiry dates were extended to another 3 months due to COVID. Trying to figure out if they are automatically extended or companies had to apply for extension. If it is automatically extended my LMIA would be valid until Sept 4th 2020, which I will be able to submit my eapr by then.
When I entered my LMIA dates on my EE profile, despite of the dates it gave me points for it. I received ITA (CEC) based on this.

If my LMIA is not considered to be valid and I take it off my profile and only if I put spouse as not accompanying then my points will be 454 which is still qualified score for the last CEC draw. I am confused how to proceed.

Please share your insights on this. Thank you.

Thanks for your response. So the letter issued last year feb 2019 is still considered valid right?

Thanks @legalfalcon

Thanks @legalfalcon

One more question

I have two GC key accounts

from one account I applied for PR and from other GC key account I applied for visitor extension

Can I add my current PR application to other GC key account? so that I can track both PR application and visitor extension from one account?

What happens to other GC account if I add my PR application to second GC account?

Will it cause any issues?

Thanks

You didn't need a second GC key. You could have simply used one GC key to file both application, but you can surely link one application to anther account. It makes no difference. The other GC key account will continue to be there, just that the application would have moved.

I have to claim 50points for job offer.
- My job is LMIA approved for NOC2174 Software developer
- I have got my first Work Permit expired in 8 months (due to passport). I got second Work permit expiring now in Oct2021.
- My initial job offer letter says full-time indefinite duration employment
- My HR letters says 40hrs, full time permanent role.
- I have worked for same employer since Apr2019

Issue is my office won't write this post-PR we will support for 1year etc as they don't know what this means legally in future. But they says already its permanent indefnite duration employment so why we need to say 1year.

Any idea if job offer with indefinite duration is good to claim 50 points. Its very important for me else i will fall below threshhold and lose ITA. Please guide @legalfalcon

Thanks in advance.

I received my AOR on July 31. I had submitted reference letter from my ex employer but that was not Comprehensive to cover all my duties.

After AOR I was able to get another reference letter from my immediate supervisor as well and it’s more detailed outlining all duties that I performed.

Last Monday I submitted this reference letter via webform but haven’t received any confirmation yet if it will be included in my application or not.

Also I noticed I may have used old UCI Number while submitting the webform though I used correct application number. the old UCI pertains to my Study permit but now for EE it’s different.

Do u think I should submit the webform again?

The job offer has to clearly state that it is "for at least one year after your permanent resident visa is issued." If this is not there, then you do not meet the criteria. Though you can explain it in you LoE and see if IRCC accepts it.

Federal Skilled Workers and Canadian Experience Class
A valid job offer has to be:
  • made by one employer
  • continuous
  • paid
  • full-time (at least 30 hours a week)
  • for at least one year after we issue your permanent resident visa
    • not seasonal
  • in a job that is NOC:
    • Skill Type 0 or
    • Skill Levels A or B
It also must be made :
  • by an employer with a new positive LMIA that approves the offer and names you and your position OR
  • if you’re currently working in Canada in a NOC 0, A or B job on a work permit that was issued based on an LMIA, and:
    • you’re working for an employer listed on your work permit
    • you’re authorized to work in Canada on the day you apply for a permanent resident visa, and when the visa is issued
    • your current employer made you an offer to give you a full-time job for at least one year if you’re accepted as a permanent resident OR
  • if you have a valid work permit for a NOC 0, A or B job that is exempt from needing an LMIA, and you:
    • are currently working for an employer specified on the work permit
    • have one year of full-time work experience (or an equal amount of part-time work) for that employer
    • have a valid job offer from that employer for at least one year after we issue your permanent resident visa

It takes 5-10 days to get a response. Also, the UCI once alloced, remains the same for all subsequent application you submit, only the application number changes.

When you submit your EE application, you will see CANXXXXXX as your UCI. This is temporary UCI number and will change to a 10 digit or an 8 digit number.
