Hi there! Im a newbie here. Just wanting to seek your advice regarding our case. Ive been living with my husband since Aug 2013. Gave birth to our daughter September of the same year. Ive applied for PR same year and landed last year, feb 22. My husband do not have status in Canada for a very long period of time. Ive been told that I should not include him with my application as to I wont be approved. So that’s what I did. After I got my PR, we decided to get mrried on April of last year to start his application per our Immigration Consultant’s advise. May 25, 2017 when IRCC received my husband’s application. Since July we did not hear anything from them. So, I decided to order the GMCS notes. Upon receiving it, there was a message there saying I did not declare our common law relationship. Thus transferring my husband’s application to a special unit of exclusion. Does this mean my husband’s application was refused because misrepresented? Please help me with this. I am really frustrated and scared that we are going to be sent back home and lose my PR

You can never sponsor your husband since you failed to declare him in your application. Yes - his application is going to be refused. Not because of misrepresentation - but because you failed to declare him at the time you applied. Your own PR status may also be at risk since this means you committed misrepresentation by stating you were single - when you were in fact common law or married.

Well you shouldn't have listened to the person who told you to not include him your PR. And also you were asked to declare your martial status at the time of landing by CBSA officers which you didn't and that is a considered misrepresentation.

I know. I should just prepare myself to leave the country. I was so stupid and naive to listen to those people around me saying that I shouldn’t include him. Now, I need to face all the consequences of my action. I should’ve search and asked for more legal information.
 
First off, unless you want to leave Canada, don't just pack up and go! There is a risk you may be investigated for misrepresentation, not you WILL be investigated. Has your husband look at options to immigrate to Canada on his own (EE, PNP, Skilled worker, etc)? You should look at the options before you drop the hammer.

I doubt her husband can immigrate to Canada on his own now. May be after he returns to his home country and gain some work experience.

So I assume that he won't be staying illegally if he can immigrate on his own. And he likely was working illegally during that time (or not working at all) and won't have any "work experience" to put on his own application.

Agreed. He cannot apply to immigrate through an economic immigration stream like Express Entry while out of status in Canada. You must have valid status in Canada to apply. So he would need to leave Canada before he can submit an application.

I do want to stay. I have a daughter turning 5 years old next month. He is a dywall installer here. He’s been here for 10 yrs without any status.

Yes there is always a chance that IRCC can start a misrepresentation investigation on your PR status. If they find you have committed misrepresentation, they will revoke your PR and ask you to leave.
 
And at the time that we were starting my application, I was so scared that my husband will be deported back home and I will be alone raising our daughter. And I will not ne able to be approved of my PR application. I was so naive back then and just listened to ol
