Please help me......

Dear Sir/Madam,

I had applied for Canadian PR through CIC in 2017 and has shown my spouse as 'non-accompanying' as me and my husband had been estranged. I finally got my ITA because of PNP nomination on the merit of my sole application.

After receiving my ITA, I again tried to convince my husband to file for his PR along with me for which he would have to only go through PCC/Medical. but he steadfastly refused it. Since, I was left with no choice, I finally filed for divorce a few days back. Given, the final divorce decree will take a year or more to be issued, given the slow pace of Indian courts. Hence please advise on following.

Query 1. I have to re-upload document in CIC portal after the ITA and I am planning to chose the Option of 'Divorced' with'No children'. Along with standard set of documents, I plan to upload following:

i) Court certified copy of divorce petition
ii) A notarized affidavit under oath that a) I will submit the final divorce decree to CIC as when I get it b) That I will never sponsor my spouse for PR
iii) Letter of explanation

Please advise, if these documents will be considered by CIC

Query 2. In the CIC portal, I have to fill in the 'divorce date'. But technically I have only filed for divorce but haven't been granted one yet. So, can I fill in the date of divorce filing as the 'divorce date'. Without this date, I cannot proceed further on the online form.


I am stuck between very difficult choices hence your advise will be great assistance to me.

I mailed CIC and got to know that my case is at CIO-Sydney. I submitted my application on 19-Feb. The current status in my CIC login is as follows:

Application status We are processing your application. We will send you a message when there is an update or if we need more information from you.
Review of eligibility We are reviewing whether you meet the eligibility requirements.
Review of medical results You passed the medical exam.
Review of additional documents We do not need additional documents.
Interview You do not need an interview. We will send you a message if this changes.
Biometrics We do not need your fingerprints. We will send you a message if this changes.
Background check We are processing your background check. We will send you a message if we need more information.
Final decision Your application is in progress. We will send you a message once the final decision has been made.

Can anyone help me what it means when they say the case is at CIO-Sydney when the background check is in progress. Shouldn't the case be at CPC/CVO at this stage?

Visa Office


There has been an obsession of finding which visa office the application is at. Many threads on this forum start with explaining how to find your visa office. Let's get to the crux of it. Finding the visa office was very relevant pre- express entry. Even after the introduction of express entry in 2015, the same practice was followed which usually was for the paper based application, but that is no longer the case. Earlier all application followed the following trajectory:


Central Intake Office - Case Processing Centre - Local Visa Office

However, this has radically changed and for all express entry, all application follow the following:

1. Central Intake Office -
The R10 (completeness check) is done at the Central Intake Office for all classes (FSW / PNP / CEC). Now even the criminality and medicals are done at CIO.

2. Case Processing Centre - There are 4 case processing offices of IRCC, which are as follows:

Sydney, Nova Scotia - Seals with the following:
  • provincial Nominee Program (PNP) – Non-Express Entry applications
  • Centralized Intake Office – Immigrant Investor Program (IIP)
  • Centralized Intake Office – Quebec Skilled Workers (QSW)
  • Centralized Intake Office – Start Up Business Class
  • Centralized Intake Office – Self Employed (SE)
  • Centralized Intake Office – Quebec Business Class (QBC)
  • Centralized Intake Office – Atlantic Immigration Pilot Program
Now has started doing eligibility for EE applications in limited numbers.

Vegreville, Alberta
Deals with Specialized permanent resident application. Those following in the category of Medical needs, work permits, work permits for spouses, study permits, co-op permits. EE applications which have a downgraded category.

This is the place where you EE application will land if any of the members in the application have a medical condition. This is where determinations of refusal, monitoring etc are made.

Now has started doing eligibility for EE applications in limited numbers.

Mississauga, Ontario
Only deals with family class PR applications.
No EE applications are dealt here so far.

Ottawa, Ontario
This is the most important processing office for all EE, and it is also the Local Visa Office for in-land applicants and those applying from USA.

Job offer is not compulsory. With your credentials u can create ur EE profile and if ur score is more than 400 u may be sent an NOI by ONIP ( they pick candidate with a minimum score of 400). It is not clear how they pick.

Last year they even picked candidates below 400 but for specific NOC's in IT

1. Do i need to upload all my individual semester marksheets along with my degree certificate,consolidated marksheet,transcript,wes report?
If yes i have lost one of my marksheet and obtained a duplicate from the University it is mentioned as duplicate at the top will it be a problem.?
2. In My spouse wes report it has been mentioned that name differs in one or more educational documents will it be Issue ?should i mention about it in loe
? Saw in the forum it is a common problem with wes since they consider passport name pls advice?
3. All my documents are have initial after my name different from passport name which has my first name and given name i think mostly it is acommon for all the applicants. Do i need to mention it in loe?

Dear Legal Falcon,

I am in IP2 and waiting for PPR. I am in a tricky situation which i mentioned below.

My mother is not well in India and i may have to travel anytime to India from my current resident country. If PPR mail comes and i have to submit my passport to Abu Dhabi VO (i am in middle East).

If i had to travel to India during this period, is there an option? Do i have to approach the Passport Seva Kendra or Embassy before submitting the passport to VO?

Appreciate your advise.

If you get the PPR while you are in India, depending on how long you will stay in India, you can request IRCC to change your VO from Abu Dhabi to New Delhi and you can submit your passport at New Delhi.

No need to approach PSK.

As the new rule came out of PCC that one have to provide PCC of a particular country if he/she stayed for 6 months in a row.

My question is that I had studied in UAE for 4 years my semester lenght was 4 months after which was the break of 1 month in winter and 3 months in summer which I use to spend in my home country.

So I have never remained in UAE for 6 months in row most I have stayed is 4 months so do I have to provide PCC of Uae?
The 6 months is cumulative and not continuous. Also, UAE does not issue PCC to non-residents. So if you no longer reside in UAE, you can mention this in LoE. Before that check the latest rules that pertain to UAE.

Most likely yes, but to confirm you will need GCMS notes.

Processing fee ($550)

and

Right of Permanent Residence Fee (RPRF). - $490


Is it after you get the eAPR ?

Is it before checking the eligibility of the Applicant ?

After R10 and Completeness check ?

After Medicals ?

After Background verification ?

After Criminality ?

After checking for Admissibility ?

or before announcing the final decision ?

Please let me know
The RPRF is asked after R10 is complete and either when eligibility has commenced or completed. The criminality, medicals are done after R10 and before eligibility.

Does medical passed also means that R10 completeness check has also passed?
In most cases yes. But in some cases where medicals is done way in advance, the medicals cal be passed before R10.

The VO at which your application is irrelevant. I wrote a post on this issue. Finding which VO the application is at is a waste of time and a burden on IRCC resources.

You cannot select divorced as you are not legally divorced. Simply select married and your spouse as non-accompanying. Then in the LoE provide a certified copy of the petition filed in the court, any orders issued, like notices, reply etc on the petition. and explain that the divorce may take time the spouse is unwilling to cooperate with you to provide medicals and PCC. Also give an undertaking that you will never sponsor your spouse.
