I have a big confusion, need your guidance.

Summary:

I have received my ITA on 18th Oct 2017, so my deadline is 17th Jan 2018. I live and work outside my home country.

My case is handled by my lawyer, and documents are still pending for the submission from his side. I tried everything to make him realise the urgency, but there is no use.

Query :

I have to travel next week to my home country, so I will be outside of my resident country from 29th Dec 2017 till 19th of Jan 2018. So, the golden question is, would that be ok if my lawyer submit the case while I am travelling to my home country??? or my old PCC will be void and shall be needing a renewed PCC after leaving my home country ? ? ?

No official documentation is ever released undated. If it is undated, then it is considered fraudulent. I would suggest that you immediately obtain new references letters with the dates and update them via CSE and also explain that it was an inadvertent error that the letters were released undated.

Do it ASAP.

You need to elaborate your question and specify if it is for EE or the NS PnP application.

Thanks for your reply. Please note that, I have applied to NS demand PNP category B with the NOC 1241 (Admin Assistant) and got nominated and finally got ITA from CIC on 20 December 2017.

Currently I am working in the education institution as Admin Assistant. During the process (ADR) of nomination the nominee officer got the confirmation about the work from the employer by e-mail as well I have provided supporting payslip and salary bank statement and appointment letter and reference letter to claim 15 points for the 7+ years of experience and accepted by the NS nomination officer.

Now I have received the PCC from UAE which states profession as HOUSE WIFE as I am under my husband sponsorship and conflict with the NOC.

I would like to get your expert opinion to handle the situation while submitting the PR application.

I want to know your advice if I should raise a complaint with IRCC regarding the delays in processing my application. Apologies for a long message. I'm first giving you a complete background of my application and at the end is my question if I should raise a complaint.

We are a family of 2+1 with 3 PCCs each for India, Dubai and Qatar.
We faced delays with obtaining home country (India) PCC for my spouse. We went ahead and applied with a LOE and receipt of the Indian PCC application. Application timeline is as follows

FSWO
AOR - 9 Jun
Meds Passed / IP1- 8 Jul
ADR Indian PCC - 10 Jul
ADR submitted - 2 Aug
FTD to London - 22 Aug
IP2 - 31 Oct
ADR
Dubai & Qatar PCC for spouse - 21 Nov

I got two set of notes
First set was before ip2
CIO didn't do our criminality even though we submitted pending PCC 20 days prior to File transfer.

Second set was after ip2
On 31st October , the day of ip2
The eligibility was passed and the officer left a note to the program assistant asking to check personal history and to request for Dubai and Qatar PCC for Spouse as it was not in correspondence.

Now I don't understand how can files uploaded electronically be not in correspondence? I had uploaded them and if they were not in correspondence then clearly it was due to an internal problem.

I got the ADR on 21 Nov, 21 days were taken just to request the document.

Before I got the notes and after getting the ADR, I emailed asking for a clarification if I need to upload existing PCCs or I need to obtain new ones. But I didn't get any response. I looked up online on CIC website and as per their specifications for PCC I noticed that my existing PCC were valid. So I wrote a LOE with reference to their website guidelines anduploaded existing PCCs.

There was no response at all. I went ahead and obtained a new PCC for Dubai as it is very easy but getting a new PCC for Qatar is challenging due to the current diplomatic problems between UAE and Qatar. I raised a CSE with new Dubai PCC and requested exemption from obtaining a new Qatar PCC if it may be needed. We lived in Qatar 2013-2015 and PCC was obtained in May 2017 but t comes with a 6 months validity.

I completed 6 months on the 9th December. My application is still having no progress. Should I wait some more or should I complaint to IRCC and also point out how can documents uploaded by me not be in correspondence which has caused all this delay?

The 6 months processing time starts from the day when the R10 is passed and not from the day the application is file or AoR. Further, if any of your document was missing, the time given to your to furnish the document, during that the file is pit on hold.

If your eligibility is complete, and all that is remaining is criminality and security, that will be done soon. No need to be concerned about it. Even if you file a complaint, you will receive a standard response and it won't affect the processing.

The rule for the PCC is as follows:

  • For the applicant’s current country of residence, the police certificate must have been issued no more than six months before the submission of the e-APR.
  • For countries in which the applicant no longer resides, the police certificate must have been issued after the last time the applicant lived in that country.
  • Police certificates are required up front and are mandatory for each country (except Canada) where an individual has lived for a total of six months or more.

Your lawyer can definitely file your application while you are travelling, there is no issue.

As regards the PCC, the IRCC rule states, "[f]or the applicant’s current country of residence, the police certificate must have been issued no more than six months before the submission of the e-APR."

So if your PCC for your country of residence was issued within last 6 months, it is good. If you are travelling to a country where you lived for more than 6 months and have to furnish a PCC, then the IRCC rule states, [f]or countries in which the applicant no longer resides, the police certificate must have been issued after the last time the applicant lived in that country.

The best time to get your first set of GCMs is 30-45 days post AoR. This is when R10 is passed and eligibility should have begun. Then you can order subsequent notes based on the progress in your file.

and the status on my profile is as follows:

Application Status: We are processing your application.
Review of Eligibility: We are reviewing whether you meet the eligibility requirements.
Review of Medical Results: You passed the medical exam.
Review of Additional Documents: We do not need additional documents.
Interview: You do not need an interview.
Biometrics: We do not need your fingerprints.
Background Check: We are processing your background check. (Went into processing on December 14th 2017)
Final Decision: Your application is in progress.

Which stage am I currently in? I haven't paid my RPRF upfront why haven't I received the request yet? Is this normal or anything to be worried about?

First off, there is no stage as NA, IP1 or IP2. All EE applications go through the following stages:

R10
Criminality
Medicals
Eligibility
Security.

Further, each application is different and you cannot compare two applications. Just because one application is processed faster, does not mean that there is anything wrong with your application.

As regards sending the originals later. It is a tricky issue as the R10, which is regulation 10 clearly states that it is the applicant's responsibility to ensure that the application is complete and all documents uploaded in the required format. Given that you send the originals later, most officers will take it on record and will not make an issue, but it is a wait and watch thing.

To know what is happening and if your documents have even been added to the file, either you can request GCMS notes and see or you can wait it out.

Will these guidelines (validity) for PCC override the 3 month or 6 month validity mentioned on the actual PCC?

My wife is a primary applicant and only us along with our 1 month old daughter are applying for pr. Just got an ITA in the last draw on 20/12/17

my wife's educational qualifications and birth certificate have her father's name spelt with a 'double L' whereas in her current and old passports it is spelt with a 'single L'.
I have been advised to make a new passport with the change in spelling

We have our inhibitions of making a new passport due to the lead time in application and receiving it back. also we are in the process of applying for my daughters passport
We will only be able to do both applications after 2 weeks since she is in her hometown at the moment

We have also been advised to make a Notarised Affidavit stating that both persons are the same
Will the Notarised Affidavit suffice in this case and not jeopardize our application

The Notarized Affidavit is my first preference as it keeps things simple for us in our situation
But can i simply rely on the Affidavit to do the trick
If it is utmost necessary to make a new passport instead then they will have to immediately return and do the needful

Please guide

Yes I have the authorization from Ministry of Labour in UAE as ADMINISTRATIVE OFFICER not ADMINISTRATIVE ASSISTANT (NOC 1241). And note that in the Labour Ministry list of job title Administrative Assistant is not available.

Usually this is a technical issue. Try clearing your browser cache and reloading in the page. Also wait for 24 hours and check. If the issue persists, then you can send the document via CSE.
