Not eligible for express entry RA (NOC Code 4012) outside Canada

Hello,

The Express Entry system automatically flagged me as not eligible after I applied. I am pretty baffled since every attorney I talked to said I am eligible for EE/FSW. Here's the message I got: "Your Express Entry profile has been reviewed and we have determined that you are not eligible for Express Entry at this time." Then it says this can be due to any of these things:

"
• not having a valid language test,
• language test results that are more than two years old,=
• a language test score that is too low,
• not having enough relevant work experience,
• not having the required education level,
• not having enough funds."

That being said, I meet all these criterias. Here's the summary of my application:

- Age: 30, single, male
- Education: PhD in Mechanical Engineering from the US (2015). I did not enter my bachelors and masters degree in my application, just PhD.
- IELTS: L: 8.5, S: 8.5, W: 7, R: 7.5, taken 01/2017 [eligible for +50 points]
- Work experience:
* Research Assistant during my PhD (Code: 4012), 20 hr/wk, 09/2009 - 06/2014 (my only job experience that actually counts)
* Mathematics modeler (Code: 2161), 40 hr/wk, 4/2015-12/2015 (this does not count since it is less than 1 year)
* Data Analyst (Code: 2161), 40 hr/wk, 9/2016-4/2017 (this does not count since it is less than 1 year)

The last time I checked, my score would be +480. I chose the primary occupation 2161. My guess is that the system does not count my Research Assistantship experience (Code 4012) as a job experience for my primary occupation which is 2161. I searched the forum and it seems that Express Entry system is not a big fan of Research Assistantship job experiences outside Canada (Code 4012). I would appreciate your thoughts on this matter.

Yes, I got my PhD degree evaluated at University of Toronto and posted it. A similar threat exists from 2015:

I think that something to do with RA/TA (NOC code 4012). I contacted two attorneys and both of them told me I am doing something wrong and they can do it for me for +2000 dollars! Interestingly enough, they are not open for hourly consultations. So if you know attorneys that offer hourly consultations, that would be also helpful. Thanks.

In CIC website, it says your work experience has to be continuous. For code 2161, you do not have continuous work experience. I got ITA last month using my Canadian RA experience of 2 year and 8 months.

Why are you putting 2161 as your primary NOC? You need 1 year continuous work ex for your primary NOC. Try changing it to 4012. May be that will work.

That's a good point. I wasn't sure it made sense to have 4012 as my intended occupation in Canada given that I won't be in school there and RA/TA wouldn't make sense. That being said, that might be the way to go. Or, I can wait 4 more months until my current job experience reaches 12 months. I am not sure!

In my work experience, I put NOC 4012. However, I am currently working in Canada with NOC 2133. So, I put NOC 2133 as intended work.

Interesting. You have not had one year experience in 2133 yet, right? So 4012 is an acceptable job experience for 2133 (electrical engineer), but no for 2161 (mathematician)? I'm confused!

I also said I already have a job offer without LMIA in 2133. Do you have a job offer as 2161? I am not sure about this. In my case, it worked.

I don't think for FSW, job offer is necessary. There might be some other mistake. How much fund did you show?

You are right, for FSW job offer is not necessary. Though, some people say I have to have at least one year of work experience in the job code I am intending to have in Canada. Perhaps having a job offer eases out that condition in your case.

I put $20,000 as fund. I have checked everything several times and didn't detect any mistake. Really, there are not a lot of mistakes that cause an automatic message three minutes after I submitted the application. Education, IELTS, etc. are pretty straight forward and the only catchy part is my job experience. Perhaps I should consult with an attorney

guys, i want to share my story. i use my RA experience to be part of my work experience, and they do count it and I got ITA on 2016-12-22, after graduation, i got a job and use this one as the current/ primary job(1yr+). if they didn't count my 4012 experience my score would be 468, which is 8 points less than the invitation number 475 at that time.
i got ppr last night, may this will give you a little bit hope. I know sometime it may feel unfair since we working so hard on our graduate study and since we are lack of so called"working experience", we will never be able to get the PR

Did you have at least one year experience in NOC 2133 when you applied for FWS and chose it as your intended work? I also do not have any other experience more than 1 year apart from NOC 4012 but Im yet to apply.
