English copy of Nikaahnama acceptable as marriage certificate?

Hi friends,

I have english copy of my Nikaahnama (it's mentioned so on document as well) which is sealed & signed. Original Nikaahnama is in Urdu. My question is, if CIC will accept this english copy of Nikaahnama in EE, or should I get marriage certificate from registrar office?

During earlier process of paper based system CIC used to accept if original (not photocopy) english copy of Nikaahnama is submitted with application. Although, I'm not sure if same will be accepted in EE, as we send scanned copies.

When you say 'English copy', is it also issued by the same department/organization?? If so, it should work without an issue, IMO.

I am from India & it is recognized as marriage certificate for most purposes. However, there is a separate process to get marriage certificate from Government Registrar. I was wondering if I need to go through hassle to arrange that.

If your nikahnama (in English) was issued by a Govt Department in India, then it is acceptable proof.

However, if the nikahnama was issued by the Govt Department only in Urdu, then you need to get it translated by an official translator recognized by CIC for the purpose (any govt translator won't do)

Religious marriages in India are not recognised legally. Therefore, the marriage certificate issued by a religious institution has to be registered. Sometimes a nikah can take place via Skype, telephone, etc. Nikah over telephone, Skype etc is valid under Shariah law but Canada doesnt accept that as a valid marriage. You havent mentioned how your nikah took place. It's better to play safe and and register your nikah. Since you are from India, the government registrar of birth, deaths and marriages will issue a marriage certificate in English and the state language on presentation of your nikahnama that is signed by the qazi. Take some wedding photos too to prove that you had your nikah in person. If you are based in Mumbai, the office is in Bandra. If you are based in any other city, I have no idea.

Thanks for the details. I have a query.. my religious marriage happened one year before (religious ceremony and have a English translation notarized) and when I went to register of marriage in my town. He mentioned that he can't issue a marriage certificate that has the actual date of marriage (which is 1 year back) and he gave a marriage certificate on that date, saying that we appeared before them. Is it ok.. on repeated request that some of them had got the marriage certificate for the past date, he mentioned that this is the process. Is this ok?

In the eyes of your religion, you got married on the days your religious marriage took place. In the eyes of the law, you got married on the date of your religious marriage if your marriage was registered within 1 month. If you waited so long, your marriage in the eyes of law has taken place on the date of getting the government registration done. Now for all official purposes, use your government marriage certificate and that date you appeared before them will be the date of your marriage.

On a website providing process of registration of marriage, there are two separate processes mentioned - Marriage solemnized but not registered & for court marriages. Check if there is any agent in your town & confirm with him. I will also confirm with someone here in Pune tomorrow.

I am hoping to get ITA on 8th March, whereas if I start process now, I will get marriage certificate in March end. If marriage registration date is mentioned as March end, will it cause any issue because of this?

We have name of spouse mentioned in each other's passport & my wife also received Canadian dependent visa based on my work permit.

I don't think that's the case. I registered my marriage four months after my religious marriage. You only have to pay a higher fee if you're late.

The marriage certificate mentions two dates: when it was solemnized and when it was registered with the government.

Guys,

What if I have
1. The religious marriage certificate (in English - not translated) signed duly by the 'Qazi' and has got government attestation at the back of the certificate (for visa purposes)
2. Spouse name added in both of our passports
3. I have a kid who also has parents name mentioned in his passport.

If I put all these documents in one pdf and upload as a marriage certification proof, will it suffice? Or I still need some Govt of India document?

I ask this because, I am Indian national but residing in Saudi Arabia. I dont think I can travel in near future and I already have an ITA.
