Dear All,

I am writing in regards to the proof of relationship question for adaptability factor in Federal Skilled Worker points under Express Entry.

My father's brother (my uncle) lives in Canada for the past 20 years and is a Canadian Citizen.

Now, I would like to claim 5 points for FSW Adaptability. However, I can provide my uncle and father's passport which states the same name of their father. Is it more than enough? or do I need to provide both of their birth certificate also? My father age is around 65 and he doesn't have a birth certificate neither do my uncle.

I can provide the following:
1. A copy of both sides of my uncle's Canadian citizenship document.
2. Evidence that my uncle currently resides in Canada must be provided through documents such as a residential lease, mortgage documents, utility bills, etc.
3. Passport copy of my uncle and my father showing the respective parents name.

Is it sufficient? Looking forward to a positive response.

Regards.

It should be fine. Also keep a letter explaining the relationship and state the fact why birth certificate is not available.

I had the same situation as yours, my aunt (father's sister) is a Canadian Citizen, however I managed to find her birth certificate which was very old and I provided it along with my dad's birth certificate and her current Canadian passport and any document that proves her residency (Utility bill etc...)

Now if you can not get hold of your uncle's birth certificate you better write an explanation letter explaining why you can't do that and I guess it shouldn't be a problem, a good idea might be a signed notarized letter from your uncle stating that you are his brother's son.

I hope this was helpful and good luck with your application.

Thanks a lot. Yes, I can get a notarized letter from my uncle. Rest I can only get passport which shows the relation between my father and uncle. I am getting 476 points in EE and just want to make sure everything is ready before making a profile. Since I expect to get an ITA in next draw.

Well, I hope an explanation would be enough. But passport is an important identification documents and that will be more than enough for the CIC.

1. No it is not, the passport won't be recognized by IRCC for the relationship. The OP will require a minimum of his uncle's 10th showing his parents and his mother's 10th showing the same parents.

Thanks for your response. My father did his 10th in 1966, I need to search for the document

I am getting 69 points without the 5 points for a relative in canada. I just want to include it so that it strengthen my application and will give me 74 points under Federal Skilled Worker.

Well is it okay if I can furnish my father's 10 certificate, 12 certificate and Bachelors degree. All of them have my grandfather's name on it.

I can furnish the same documents of my uncle also.

Is that okay?

Hey Guys I am facing the same issue..
So i have received ITA under CEC
I did input in my profile that my uncle (Dad's brother) is Canadian Citizen.
-My dad has indian passport with his fathers name
-My uncle has Canadian passport and his fathers name is not mentioned.
(Both of them dont have their birth certificate)

My uncle has his old cancelled indian passport but there is spelling mistake in his fathers and mothers name therefore my dads current indian passport and my uncles old cancelled indian passport fathers name spelling do not match.....

=What options do i have, Will 10 and 12 Grade marksheets work, any other option available.... My Points were 468 and the cutoff was 447- is it okay to remove my uncle as a family member (when i was on study permit- i mentioned in my document about my uncle- no document was needed at that time)

Please suggest guys

Since you've been invited under CEC stating having a relative in Canada makes no difference to your application.

Remove him from the application and state in a LOE the issue with the passport and the fact that this change does not affect your CRS or eligibility.

Thank you so much for your reply
-Can you please give me some points on what i should state on LOE in-regards to passport issue?
=Do you mean that i should say Because i am not able to provide any proof of his relationship with me therefore i have removed his name from my relative in the form. And also after doing this my CRS or eligibility is not getting effected under CEC.=

Can you please help me with a rough draft.

You help is much appreciated

I also have an Uncle and an Aunt that are both Canadian citizens, but do not currently reside in Canada (for the past 1-2 years). They work for an American company and do not have property in Canada, hence they don't pay taxes.

Would the fact that I can prove he is a citizen by copy of the passport and the birth certificate (brother of my mother) be enough to claim the 5 points under FSW?

Your responses are much appreciated.

Regards,
Pete
