Criminal Record Certificate from Spain

Hi there,

I'm missing one last document before submitting my PR application and it's a criminal record certificate from Spain for my girlfriend (common law) since she spent there over a year (studying/working).

We applied by post as described here www .mjusticia.gob.es on June 9. but haven't received anything back yet.

We sent them
- 790 form
- proof of payment
- certified photocopy of passport (by Canadian notary)

In another document it says legalize a photocopy of passport at your nearest Spanish consulate. Is there a difference between having it notarized by a Canadian notary and having it legalized at a consulate? Anyway even if we did something wrong, they should at least return the application or let us know whether we're missing something.

We tried to email Ministry of Justice in Madrid twice but no response yet. We have just couple weeks left to submit the application so getting little bit worried.

Yes. A Canadian notary can only make a certified copy of a passport, they cannot determine whether the passport itself is authentic. Presumably the staff at the consulate can verify the authenticity of the passport.

Hey Tomas,

I am in similar situation as yours. I too need spanish pcc for dependent. How long did it take for you to get your pcc? Was the pcc in spanish? If so then did you notarize it later on? Any information on this will be highly appreciated.

Well, technically speaking it shouldn't take long but they somehow forgot to send it to us. You can either apply by mail or you can even have someone in Spain to apply on your behalf. We did both (the first option twice). We had to wait for almost 2 months because of that ignorant idiots who didn't want to admit their mistake. Eventually, I ended up with 3 certificates haha. Anyway, it's in Spanish and you only need to get it translated by a certificated spanish-english translator. No need for legalization etc.

Thanks Tomas for the info. At least this gives hope to us. I am planning to send 790 form tomorrow via dhl with retun envelop as well. Plz give suggestions on how i can do things so that they do not do stupid thongs and it takes long time. And in addition please share your experience on how i can request our friend in spain, if needed. What kind of docuemnts are required. And for sending 790 form, i am paying quite a lot to make bank TT. So if possible i will follow the friend in spain option. Once again i am really grateful for your insights.

If you are applying outside Spain then your friend can not pay inside Spain. His money will be returned back and transaction will fail. However it will take around 1 week t fail the transaction and you will not know it at same time.

Better to do a wire transfer with fixed destination amount 3.70 euro, TD Can do this and will charge around 30 CAD as fee. If you are good customer of TD you can request wave off of partial fee.

Spanish office in Madrid are fast enough and will issue PCC same or next day they get the application. Will suggest to send a certified copy of applicant's address proof too.

By Certified address, do you mean notarized registration card of present country of residence? Do you suggest an original copy of notarized copy or photocopy? And if not notarized, then what other form of doc would you suggest. My current bank has quoted similar price (around 30$). And spanish office in madrid, you mean the ministry of justice in madrid right?

Sorry for bothering you so much, but this issue has consumed a lot of time and energy. Have given call to ministry of justice in madrid quite a few times and wrote on other forums as well. But hadnt found anybody who could offer help. Finally found you and feel releived. Your help has given hope in doing things properly. Thank you.

Me and my all friends send following things

1. application form
2. copy of temporary residence card of Spain
3. certified copy of current passport
4. Certified copy of Canadian driving licence (address proof)
5. proof of payment

Spanish office in Madrid, yes I mean the ministry of justice in Madrid, works very fast, I can bet they will not take more than 3 days to issue and ship the certificate.

I sent by regular Canada Post and they shipped by regular mail, It took around 4 weeks. But if you can avoid shipping time by using dhl or other guy, you should get it in 1 week

also, do not forget to bargain with bank on wire fee :), A wire has two fee 1. branch fee 2. Actual wire fee and you can negotiate on Branch fee

Can i make bank draft for payment? My bank is suggesting this method as fee is almost 1/4 of TT (wire).

I suggest no, because outside Spain you can only pay by wire. My friend did lots of research and also sent many mails to ministry of justice office and finally concluded that wire is only option. I did the same and I know 6 people in my friend circle who sent by wire.

I know it is bit painful to pay 30 CAD as fee for 3.70 euro amount but this is the safest option.

It says everywhere it is needs to be legalized

Finally received spanish PCC yesterday. That is within 14 days of them receiving my application. And received ITA as well, march 01. Wanted to share that i received PCC as you and many people here were of such great help. Thank you very much everyone. Now, for translation how do i proceed? Will spanish embassy translate it for me as i am not spanish national? If I translate it through other translators, do i need to fill affidavit of translator?
